Default Maximum legal stay for non resident

Hi

I did post this question a few weeks ago, but was unavoidably unable to
check the replies. My apologies to those who replied before, but hopefully
you guys will do me the favour of considering this again:

How long can I, as a UK citizen legally stay in Canada before leaving, and
how long would I have to remain out of Canada before returning?

Also, my wife is Canadian, could I apply for residency permit while in
Canada, or would I need to do so before entering the country. (How long
does such a process typically take, I'm told my case would be very
straightforward)?

You could apply from within Canada so long as you are legally present in
Canada. Check out the CIC website re spousal sponsorship. Its at
www.cic.gc.ca

hi to all,
i applied my immigration under business entrepreneur,
around august 2002 at buffalo, i was received my file
# around 3rd week of February 2003,my e-client status
say's in process , i seen internet site of
www.dfait-maeci.gc.ca and they say's they are
assessing application received by march 2003,if my
file# received in feb 2003 why i did not get my
medical or interviewed letter from immigration or when
i will received my medical ,and after i received my
notice of assessment letter how long take time to
finalize my application and get the immigration visa.
looking forward to this e-mail will be appreciated

Yes, Buffalo is assessing applications received in March and even April of
2003 (we just got assessment with waiver for case filed in second half of
April 2003) - but it doesn't mean that they are assessing all cases received
at that time or earlier. There are many cases from 2002 and earlier that
haven't been yet assessed in Buffalo. A lot depends from how well
application package was prepared and thus if it requires more work that just
screening the package to make assessment. Well prepared and conclusively
proven cases "fly" rather smoothly through the process, while those less
conclusively documented wait for their turn.

Hi Raj,
We also applied under business entrepaneur at buffalo.
AOR Dec 3rd 2002.
initial assessment expected July 2003,was notified of delay until Jan 2004 then again until March 2004.And last notification was that there was a large amount of applications so we would now have our initial assessment in Aug 2004 .Twenty months after Aor.
We have used a very good lawyer (advertised on this site)and our application looked very professional and thorough.
We also can't understand why Buffalo are processing applications received in March 2003 and they tell us that ours won't be processed until Aug 2004.
How do we know that they won't delay us further when it comes to this date.How can they predict it will take them this long to get to our file, especially when in Jan they expected to assess it 6 weeks later in March.
We are so frustrated now.
Hope you hear something soon.

my application filed by reputed consultant and i hope they filed my application well prepared,my question is that how long time i have to wait to get medical/interview papers from consulate ,and what's the current time frame for interview after received medical or interview papers,

Again - I have no idea about how well your application package was prepared
and how conclusively all was documented. Regardless how "reputed" your
consultant may be it doesn't seem that work was done as it should - your
timeline just proves it, sorry. You should ask your consultant as he or she
is the one who prepared the case and can monitor the process.

Hello there,

With a UK passport, you can stay here for up to 6 months, but this is at the discretion of the immigration officer at the port of entry. You will have to explain why you want to stay that long, just say you are here to spend some time with her.

Your wife is the one that has to sponsor you, since she is canadian, and to do this, you guys need to use the family class applications ( spousal ), but you guys are going to have to prove that you have been together for a while with documents ( letters, phone records, pictures etc etc ).

Once she decides to sponsor you from inside, you cannot leave the country, and to remain legal whilst your application is being processed from Alberta, you have to renew your visa ( $75 ) a month an a half before it expires. If you don't, you will be here illegally, and you can screw up your application.

Another option is for you to go back to the UK, and she sponsors you from there. You are not the sponsor, she is, and she doesn't need to prove finances, since this is a spousal application. She would be exempted from this clause !
