Legal Stay
Hi,
I am a permanent resident of Canada. My wife is with me here in Canada but she is on
a visitor visa. We will be applying for her permanent residence by the end of this
month as we are in the process of collecting documents for the application (
basically the marriage certificate from Ontario ). Her visa expires on Dec 31. Will
she be eligible to stay in Canada legally even after her visa expires provided that
the sponsorship application in the process? Or do I have to re-apply for the visitor
visa for her in order to extend it?
Another question, since she is my spouse; is she legally eligible to work in Canada
or she needs to apply for employment authorization?
I would really appreciate if somebody would answer these questions?
Thank in advance. Ed

Re: Legal Stay
Your wife must keep her visitor status valid at all times until her PR status is
granted, so she must apply for extension of her current visa before it expires
(about 6 weeks prior to expiration will be sufficiently safe for such application to
be filed).
If your wife wants to work in Canada prior to becoming a PR then she needs work
permit - the best is to include application for such together with the PR sponsorship
application package.
