it is 3 years in the previous 4 years, so no the count does get reset to
sero, it continues....
getting a visa for his 'wife' (secret or otherwise) will require that the
marriage is legally recognized in order for him to apply for her visa.

Default Landed Immigrant status Questions

My nephew is a landed immigrant and he's planning to take a vacation back
home in a couple of months. He's got a girlfriend back home, and as far as i
know, they got engaged when my nephew was already here. And as what i have
heard from my relatives, they are planning to get married or have a secret
marriage. now, worried about my nephew, i started to look over the internet
for rules regarding about this, but i couldn't find any. so here's my
questions.

-My nephew is a landed immigrant, and the date he plans to leave for a
vacation is just around 40 days before his 3rd year here in canada as a
landed immigrant. does that mean he has to start all over again counting the
3-year physical residence here in canada? or the count would still be
continued when he comes back?

-As I've said, they're thinking about the possibility of getting married,
whether as a common law or secret marriage. would that affect my nephew's
status? what are the things he must do when he gets back if they did this?

Getting married will not affect your nephew's PR status. But marriage will have
to be a legal one if he wants to sponsor his wife once he gets back to Canada.
There is no common-law relationship if they didn't live together for at least a
year, so only legal marriage will work. If it is a "secret" relationship then
conjugal partner category will also not work. And marriage cannot be "too
secret" - they will have to be married in accordance with law and tradition in
your nephew's home country as in the case of anything short of that it will be
hard to prove that it is a real thing, not just a marriage of convenience for
the purpose of immigration.

thanks for the reply

ok. s'pose they get married (since that's what's probably going to happen),
are there any things that my nephew would need to do once he gets back here
in Canada---(about his immigration, papers, etc.)? I've talked to my nephew
and it seems that they're/he's not in a rush to sponsor(to live with him
here in Canada) his gf/fiancee once they get married (from what I remember,
they're probably going to wait for at least 3 more years).
