Importing a Car under finance

Default Importing a Car under finance

Hi, My Toyota camry 2002 is financed by Toyota Financial. One of the
clause in the agreement under the heading "Using the Vehicle" clearly
says,"You agree not to remove the vehicle from the US or Canada or to
sell, rent, lease or transfer any interest in the vehicle or this
contract without our written permission."
Since it says US or Canada, can I import my vehicle without their
writen permission and continue to pay them my monthly payment (I am
paying it online through my US checking acct, so I do not have problem
to convert to US dollar.).
Thank you for any suggestion.

You will still need formal approval if they hold the title because US
customs must clear your title before you can export it and they want
proof that you can export it if you don't hold clear title.

Hi, Thank you very much for your comment. I actually talked to Toyota
Financial today and their reaction was,"even it is written that way I
can not take my car to Canada for more than 30 days". So, I decided to
pay off the loan and import it. I still have another question. Can I
import the car showing my pay off paper work from my financial
institution (in my case Toyota financial) for USA/Canada custom or do
I need to have papers from DMV also? As I have heard, DMV processing
takes time. Do you know, how long time DMV takes to give me new title
after I submitted the loan pay off paper from my creditor to DMV?

Thanks for any suggestion or comments

You need the title. Now, if the title has the finance company as lien
holder, you'll have to either get clear title, or a letter form the
finance company indicating they will relinquish lien on title and you
are free to remove the car from the US.

If you do go the route of new title through the DMV, you'll have to wait
until it's cleared to get the new title, since if you left before, you'd
no longer have good title because you're not resident in that state!

You cannot import it without their permission and without the original Title
or a certified copy of the original Title. Actually, you cannot Export it
from the US either. They will not let you pass thru customs.


I have been dealing with a similar problem. My wife and own a 2002 Subaru
that is being financed at Chase Bank. Chase (and presumable Subaru) has
given us permission. They require a dossier that inclused a written request,
references in the US and Canada, current and Canadian address, p[roof of
Canadian insurance listing the bank as lei holder (State farm is a good
choice, because they operate in the US and Ontario, and were able to
transfer our safe driving discounts). I actually spoke to Chase today, and
they have approved the export. They will send me a permission letter and the
Title.

You then fax the title to the [ort if entry. 72 hours in advance. The US
side looks and your car, your title, your permission letter and compares It
with the title that you faxed, They stamp it. You drive across the bridge
(border) and hand this stuff to Canadian customs and pay your RIV fee and
hope for the best.

We'll be moving July 16th. I hope it goes this smoothly.

Bu the simple answer is you cannot export the car from the US without the
bank's permission.

We had to send the *original title* to US Customs ... they wouldn't
allow a copy.

Yes, we recently exported our Subaru and the US customs required the
original title. Since the title was held by my finance company they sent
the original title (along with the letter of permission to export) but it
was stamped *for transfer purposes only*
It only took us an hour at the border, not the three days we were told it
would be.

The legal requirement is that they have the title 72 hours in advance of
the vehicle being exported.
