Default Humanitarian Visa

Just thought I would share our experience on applying for the above visa as we found it so difficult to get information regarding it. Our daughter was accepted to come with us to Canada in 2008 and was on the PNP Certificate as a dependent but by the time it went to the Canadian High Commission in London she had passed the age of 22 and they refused her. We all came together to Canada and our daughter joined us on a BUNAC visa and then she applied for a H & C visa. We contacted different immigration consultants and some said we had no hope of approval and others 50/50. We have had this hanging over us for 2 years and finally she had her interview to day at the local Immigration office and it was approved. I must admit we did use an incompetent Immigration lawyer who caused the delays in our original PR application and now have gone out of business which helped our case, but after so much negative feedback from lawyers we could not believe how straight forward it was. Our daughter even extended her BUNAC visa under this H & C application, something she would not normally of been allowed to do and worked all the way through. Our Immigration officer was lovely and really empathized with our case. We are all over the moon that she has been approved for PR and just wanted to share our story in case anyone else finds it useful.

Great news! Did you use an immigration lawyer in the end, or did you end up doing it yourself?

Yes we used two. One when we sent it off and then another we were recommended when she had the interview a year later. We sent off an extension for her BUNAC visa even though it did say on the visa she could not extend it, on the advice of the first, which we would never of thought of doing and she carried on working and was under implied status. The second immigration lawyer who looked at the case said she had been working illegally and it should not have been extended as it said it could not be extended on the visa. What a mess we were in. As it turned out the first immigration was right and she was working legally. It just goes to show even the immigration lawyers do not know.All I know is we ourselves studied the criteria, sent in evidence and addressed each item in our covering letter and the immigration officer who took our case was very sympathetic and really the questions she asked were just a formality. The work permit application was kept on file to await a final decision and she was ok to work.
If anyone ever has a case like ours we will be happy to give advice. I think we know as much now as any immigration lawyer about this visa!
