And you are wrong here again. This is not a "discussion" forum. This
is an immigration forum where we all are coming for expert's advice
and to learn from experience of others. Discussion forums on the
Usenet are clearly distinguished with "discussion" element in the
newsgroups's name.

You want to convey your views or guesses then you are free to post in
forums marked "discussion".

This forum is not for discussion or opinions - it is for experts'
advice and factual reporting of experience in the immigration process.

Andrew and Nick were both well within good manners, none of them
called you names or insulted you. I think that if someone is posting
"bull***t" as Andrew described your "advice" then such post deserves
to be called what it is, a "bull***t"

Take your "views", "discussions" and "guesses" to proper forum.

Since we are on the subject of taxation, my question is: Will income earned overseas become taxable upon the person having landed as a permanent resident? What if five days after landing he moves back to his native country for the next one year and thereafter he then re-locates and settles permanently in Canada?In other words, can he claim to be non-resident for tax purpose even after he has landed on the basis that he has not actually re-located permanently to Canada?

Appreciate views on this issue

I've been wondering about the same thing and this is what I managed to dig out.

When you land in Canada you gain your PR status from the stand point of the immigration law. However, you will only gain the PR status for tax purposes in Canada, after you have established your habitual residence there.

If you left 5 days after landing and continued working and living in your country of origin, your income will not be taxed in Canada. However, once you established your habitual residency there, i.e. rented/bougth a residence, opened bank accounts, moved your dependants to Canada etc, this is when you become a resident of Canada for tax purposes.

In case you read any threads prior to Jun 28, 2003 ... and a
consideration for the future ...

It used to be that "landing" required that you actually established your
residence in Canada (from my understanding, it could still be
interpreted that way, but for now, is not) and a part of that was
actually being a tax resident. Avoiding becoming a tax resident would
be a declaration that you had NOT established your residence and that
your landing was bogus and could be declared void. If CIC decided to
again require that establishing residence was a part of landing, this
would again be a criterion for determining that you had indeed "landed".

For now though, you become taxable as a Canadian Tax resident on the
date when you finally enter Canada to establish residence. Note that
CCRA is likely to consider short absences after landing as not
significant and

Allright everybody, so some feel this is NOT a discussion forum but just has
the word "discussion" embedded in the name. That logic wont go too far with
life, as normally we take things for what they are called.

If some of us feel we come here to get expert advice, then should't it a
experts forum, or the best way would be the Experts can put up their own
website and call it what they like.

I am compelled to answer to Ignorance and herd mentality. Guys if this isn't
a discussion forum, why are you spending your time to reply to thread
explaining what this forum is about, JUST ask for questions from experts and
wait for the answers. Why are you "discussing" the purpose of this group ?

And one of you think your dear expert was correct in calling my comments
"Bulls***t". Why is that, can polished people not talk without that ? Can
one not express in non-derogatory words ? I agree, some cant, coz thats what
they have learnt and thats what they will use.

Lastly guys, I enjoy this group for its various colors and will continue to
be myself - opinionated, independent and polite.

I suppose one needs to look at the visa condition which requires "landing" within a certain period ie whether it requires mere entry to Canada or entry a permanent resident . Any link to the relevant regulation for such visa condition?

No, there isn't ... it was more of a policy interpretation of the law
which for now seems to have been dropped.
