Unhappy HELP!

My Husband has applied for us to work in Canada for 3-5 years through a LMO/work permit. All has gone fantastic, due to fly in 2 weeks, Husband start work, kids, doc's, hospitals all sorted.
However we received a letter today asking for a notarized original letter from our childrens natural father!!!!!!!!!!
Little history, 1st husband left myself & our 4 daughters, youngest was 3 months & he never really looked back. Settled in court for full residency to myself, joint care & control. 1st husband then never followed agreed visiting, would see them every month or so for approx 2 years. Then he & his new wife & 2 kids disappeared off the face of the earth. That was 7 years ago. I know they moved to Australia, he has dual nationality. However there the trail ends. I don't know of any family I could contact & quite frankly why should I? He decided he'd made a few mistakes in his life, ie us. So he just went out & started again, he caused us a great deal of misery & NEVER has he paid a penny towards the girls. We now have a caring, supportive husband/ step Dad & a little Brother to round things off.
Please does anyone have advice?
I know I could go to court, however time is running out, my husband could lose his job, if his employer is made to wait.
I've contacted the csa, they have agreed to fax a statement of the fact that there has never been any payments & I can get a notarized declaration from a solicitor explaining absence of parent. Would this be enough?
I've been searching through the threads (not sure on terminology!) & have seen this on one of the threads.
Thanks in advance for any little tid bits.

I'm so sorry that yur first hubby was a complete shit!!!! Not an ideal solution i know but could your hubby go by himself so as not to lose job etc and you follow at a later date.....?

Hiya,

Sorry to hear about your problem, we are in a similar situation to you, although as our SW application has only just gone in it is not as urgent as yours right now. I posted a thread on here last month, if you do a search under "proof of child custody" you will get my thread plus others that may be useful. As far as I am aware you do need a letter from your ex husband confirming you can take your children out of the country. If he refuses you have to apply to the family court for permission to leave (and I would imagine if you have no knowledge of his exact whereabouts the same would apply).

Our daughter is 13 at the present and has had no contact for 12 years, the court will apparently also take the child's opinion into consideration if they are 15 or 16. I know just how you feel it is outrageous that you have to get permission from someone who has never been there for them or paid any maintenance to be able to do what you know is best for the children and your new family. :curse:

Hope you are able to find some answers, if not I would advise you to seek legal advice asap as it may take some time to sort out. I agree with Batfink, can't your OH go on out to Canada so he doesn't lose the job.

I dont "know" anything on this, but in the first instance i would suggest putting all of that info in writing to them, with the fax re no support, asap. Good luck to you and your family.

sorry to hear about this mess - but dont worry hun it will sort itself out for sure.

This topic has been raised quite alot over the last 4 or 5 months - did you try and search the forum for "absent parent" ? This should for sure bring something up for you as a few people are in the same situation.

sorry have been to Ca for a couple of weeks and can't remember who it was who posted on the subject.

Am sure that one of the solutions suggested in the thread was that if you had a residency order and what you suggested yourself from CSA that should be OK but go check it out and see what it says.

Will also look for it for you

Wow, blown away by this site! So many replies, thought I wouldn't hear anything!!! Thank you all for the encouragement, wisdom & for just being down right friendly people. When you are feeling like the little person that gets trod on, its such a boost to remember their is decent people still around. bless you one & all.

Thank you, yes, have spent the last 24 hrs (tick, tock, aghhh) exploring options. Hub will go 1st if he has too, however, just frustrated that we have to put each other & kids through that.

All sorted, got fax from csa yesterday afternoon, they where great. Dec done for Monday pm. will be on CHC's desk Tuesday am. Nothing ventured........... Fingers crossed, heart in mouth.XXXXX

You need to contact a lawyer who dealt with your divorce and abandonment initially and the lawyer will help to draw up a document stating the facts that you mention and it may then be ratified by a lawyer who has powers of notarisation and you may then forward this to CIC. I have had a similar experience not regarding children but at the time i applied for sw category i was separated and that was the procedure because exH wasn't cooperative. Make sure you get this cleared up very quickly. I used the services of an immigration lawyer who took the pressure of me.

Quick update: Well they have accepeted the Sat Dec......... Big sigh of relief. They have now asked for a medical for One of the children, noone else, sent that last week, however with bombs & postal strikes not even sure they have received them!!!!!
Hubby is still with us as Canadain boss is being sooooo supportive.
Just wanted to say thanks agian, would have gone insane without this site & all you great people.
Whistler, keep a few sunny days for us.

It's a court jobby for clarity or a notarised document and proof that you have sole custody and that ex has played no part financially or parentally for ex amount of time etc.

PS. I think you ex could adopt your kids BTW.
