Default Getting PR Card and coming back to US

Hi all,

I just recently got by PR after interview in LA. I have indian
passport and have H-1 status in the US. I came to US on B-1 and
converted into H-1. I do not H-1 Visa stamp on my passport. It will
take me 3 - 6 months to wrap up in the US to go to canada permanently.
I have the following questions

1. How long it will take me to get PR card ? I plan to be in Toronto
for 1 week before coming back to US. In case it takes longer, Can I
ask them to send to my brother residence or one has to go personally
to collect the Card.

2. Has anyone had the experience of getting H-1 visa from Toronto ?

3. Are you allowed to comeback to US if they refuse to stamp your visa
in Toronto ?

Please let me know if anybody has gone through the similar experience
?

Thx.,

Mani

Mani,

You can provide your brother's home address.
However, in some cases, applicants are asked to pick up the card in-person.
If such happens with you, you can drive to Canada.
You won't need PR card when driving in your own car.

If you cannot drive and must fly, then you can apply for travel document
from Canadian consulate.

    > 2. Has anyone had the experience of getting H-1 visa from Toronto ?

I asked the same question from my US immigation lawyer.
According to her, it should be ok as long as :
-You have a previous H-1B stamp on your passport of the same employer you
are currently with
-You don't belong to any of the blacklisted countries
-Your name is not a very common one that can come-up in a security name
check and thus trigger further investigations
-Some of your educational degrees are from the US/Canada

No.
You must go back to your home country and apply for H-1 visa there.

Hope this helps some.

you are return to US if you go only to Canada and stay less than 30 days,
provided you have your old I-94 and new extended one when you changed
status.

Please help me in answering my questions. I am currently with valid
H1 visa and working in US. I have Canadian visa valid until August for
the entry. I am alanning to enter Canda next month, just for entry and
come back to US on the same day or next day.

I do not have plans to go back to Canada for the next 2 years, unless
until there is some problem with my current job.

Please review my questions/plans and help me with your expert advice.

1. I am planning to give my friend's address for the PR card to mail.

2. Other than PR card, do I need to apply for anything else.(SIN
etc.,)

3. I am planning to drive from US (Montreal border) and come back the
same way. Do I need to consider anything? My car is registered in US
and I have valid US license.

4. Other than -- Proof of funds, papers from canadian consulate and
passports, Do I need to bring any other documents? If yes, please help
me here...

5. Will they ask me to come and collect the PR card? Is there a way to
prevent that happening?

6. Can I return on the same day or next day? or Should I stay more?

7. I am already processing GC in USA. Will officers in the border ask
about that? If they come to know about GC processing, will it lead any
problems?

8. Any thing else that I should aware of based on my above mentioned
criteria? Please...

I really appreciate your answers for my questions...It will be a great
help.

Thank you very much,
spj.

Most probablt should be fine !!
    > 2. Other than PR card, do I need to apply for anything else.(SIN

No, not until you move permanently to Canada.

As long as you have CSQ, PQ should be fine.
What will you tell them about the car, why are you importing or not
importing it ??

Goods to follow, if any

    > 5. Will they ask me to come and collect the PR card? Is there a way to

They may, chances are remote, and there is nothing to prevent.
    > 6. Can I return on the same day or next day? or Should I stay more?

Sure

Canada is not concerned about that, but at some point you have to decide
where you want PR.

Be cheerful positive and good luck.

==> You may have problems with residency requirements - you need to spend 183 days each year in Canada to keep the PR status alive. Please check the details

Hi Pmm,

Some web sites aren't up-to-date and still quote the old requirement of 183 days / year. But that seems to have changed in June 2002 with IRPA.

Thanks for the clarification.
