Experts please help: Returning Resident Permit extension
Experts please help: Returning Resident Permit extension
My parent landed in Canada on August 15 2001. After spending 6 months
with us in Canada they went back to India and obtained a RRP from New
Delhi consulate. The current RRP going to expiry on October 15, 2002.
When we contacted New Delhi consulate for RRP extension, we came to
know that there is NO MORE RRP. As per the new rules, one can stay
away for 2 year and don’t need any kind of permit to
return/reenter Canada.
Now I end up with more questions and the answer I was looking for.
Hope the experts can help me answer my questions
1. Can my parents stay back in India for one more year with out any
prior permits?
2. What kind of questions or problems they might face when they try to
enter Canada
3. Is this new 2 years rule applies for all the Landed immigrants (who
left the country before the June 28, 2002)?
4. What are there obligations to words October 15, 2002 deadline, with
reference to current RRP. Can they just ignore current RRP?

They can stay up to the permitted time away from Canada from their date
of arrival in Canada in the 5 year period starting with their date of
arrival, and must ensure that they stay in Canada for the required time
in the previous 5 years. So, in other words, if they spend all this
time in India, and come close to the limit but not exceed it, then go to
the US a year later for a time, they must watch the time spent in the
US.

a lot of people are getting their math backwards... residency requirement to maintain pr status, is to live in canada for 2 years out of every 5... that means you can be out of canada for 3 years out of five...
and any time spent outside of canada on a rrp, is considered time spent in canada for the purpose of maintaining pr status (NOT CITIZENSHIP)... the number of days between being issued the rrp and the expiry of the rrp will count towards the 2/5 requirement as time spent in canada...
