eTA declined - criminal record
Hello everyone,
I’ve not been on the forum for a long time, but it was invaluable as I navigated my immigration journey a good number of years ago. I thought I’d throw this out to the group, as I’m getting lost in CIC (are they even called that anymore?!) pdf’s and web pages.
My sister, husband and kids are hoping to visit in July 2024, and submitted their eTA request. The husband chose ‘yes’ for the question about whether or not he’s been arrested or convicted. This was for a crime 11 years ago, small theft against his employer. He was given a suspended sentence, although I’m not aware of the length (I wasn’t even aware of the conviction until this came up). Three weeks after submission, he received an e-mail to say his eTA had been declined. There was no request for further info in that three week period.
Based on a post I’d seen on here, I thought he would have had the opportunity to explain the situation, provide dates, and possibly a criminal record check through the eTA process, and given the time passed be deemed rehabilitated (he’s had no arrests or convictions since, so I’ve been told). It seems that’s not the case. What’s the next step, is it a formal application, and how long does this typically take?

Sounds like his suspended sentence didn't end long enough ago for him to be deemed rehabilitated. If you want to be doubly sure, you'd need to ask him how long that was for and when it was completed.
A full criminal rehab application can take a year or more unfortunately, but sometimes can be quicker. So they just need to get it submitted asap and hope for the best. https://www.canada.ca/en/immigration...-activity.html
