Yes but whether using an American or British passport he will be denied entry due to his DUI, which is irrelevant to his nationality(ies). Therefore he wont evade anything if he uses a UK passport "instead of" an American one, which is by the way incorrect; you are implying that using a "different" passport than the US one would be "violating" something when actually you dont have to use a US passport to enter Canada. Both US and UK citizens get 6 months visa waiver. So if OP wasnt DUI he could in fact use his british passport if he wanted the stamp in there for whatever reason. It isn't illegal.

Another point on this. If a Briton comes to Canada for a vacation, and they have a DUI, they also are inadmissible. Commonwealth or not, doesn't absolve the criminal history.

dgagitw gave you some excellent advice in post #8. I recommend you pursue it.

Ok, slight misunderstanding. His original post(s) sounded (to me at least) like he was suggesting to use his UK passport to enter, and deny his residence in the USA if asked.

That would be an offence.

Sorry.... Yes it would be, correct. Wouldnt work anyhow though CBSA would see his file from the US and see that he lives there and has a DUI there.

Thanks all. This is the one and only time I have ever been in trouble so I am trying all options. BTW is there any other countries I would have trouble getting into?

A straightforward DUI shouldn't affect entry to Australia, at the worst they will ask for circumstances with the visa application but it shouldn't affect visa issuance.
Very different to Canada in that they don't have "inadmissability" as such, there is a lot more leeway on a case by case basis.
