Do we need to submit proof of Sponsors Child Support Payments

Default Do we need to submit proof of Sponsors Child Support Payments

The Sponsorship forms don't ask for proof of child support payments, but ask that you are up to date and paying them. My husband pays cash direct to his ex wife and gets a receipt. Should we submit the latest receipts with the sponsorship forms as proof? or do they not need proof. Just wondering if they will come back at a later date and ask for proof and if we submit the receipts at the time of submission of application this may prevent any delays. what do you think?

Divorced foreign nationals
Divorced applicants may have legal obligations arising from their divorce. These often include alimony or child-support payments, as well as the terms of child custody orders. An obligation to pay alimony or child support is material only to an applicant’s ability to adapt to Canada.
Officers may not insist that applicants make arrangements to continue to pay alimony or child support. Nor can officers insist they submit proof that their ex-spouses or common-law partners are satisfied with payment arrangements. If these arrangements break down, the ex-spouses or common-law partners must apply to a Canadian court to have their rights recognized.

I think PMM's response would depend if your husband is Canadian or not.

When my Canadian husband sponsored me in 2005 CIC required a letter from the Family Responsibility Office to confirm that he was not in arrears of child support. It took about 3 weeks to obtain and delayed the application.

Persons in default of a court-ordered or court-registered support obligation to pay support are not eligible to sponsor. This includes persons who are and who are not registered with the responsible federal, provincial or territorial authority as being in default of family support obligations are not eligible to sponsor. A person who is unable or unwilling to live up to current family related legal financial obligations is likely a poor risk for honouring a future family related financial commitment.

I would suggest getting a clearance letter from whichever authority oversees child support in the area his children live and submitting it with the application to sponsor.

How would they be able to provide hime with a clearance letter if he pays by cash direct to the mother. If they checked and she wanted to be bad, she could say no he hasnt, couldnt she?

He could get a clearance letter because if he was in default she would have applied to the family responsibility office in his area for them to take on the file and pursue him.

They would be able to provide a letter confirming that according to their records no default had been registered.

As to your other comment, yes she could, which is why I urge anyone who is paying child support to do it through official channels! I have 2 friends who have been 'stung' for thousands of dollars in child support arrears because they paid cash and the 'offended' ex spouse stated they hadn't paid a penny. Was the amount of support he is paying approved by the court? If not, then he is putting himself at risk.
