Decision Made prior to medicals and initial assessment!

Default Decision Made prior to medicals and initial assessment!

Dear experts and other fellow group members,

May be most of you are aware of my case details. Anyway, pl let me put the details of my case once again here.

Originally applied through CHC, New Delhi: April 2001

AOR: July 2001 (from New Delhi)

File transfer to Buffalo: Feb 2002 (after my arrival in Canada on two year study permit in Sep 2001)

New AOR: Feb 2002 (from Buffalo)

Asked for additional updated information: April 2003

Sent in all the requested information: Apr 2003

Received the initial assessment: Jun 2003, Awarded 74 points and refused the case, in view of insufficient points. (but the fact is that I required only 70 points, as I come under the transition law by virtue of the original date of application)

Requested for reconsideration on the above cited reasons: Jun 2003

E-client changed from "decsion made" to "in process": July 2003

No communication from Buffalo about my case after my request for reconsideartion

Status remain same in Ecleint: until Sep 2003

Meantime, represented the case to the honourable Immigration Minister and Member of Parliamnet: Jun 2003

Received a letter from Minister's office in Sep 2003 (Sep 26, 2003), saying that visa officials are reviewing my case and I would be informed of their decision very soon.

Talked to secretary of MP: During this time, I was asked to apply for extension of visa to maintain my status in Canada (I did not tell them that my status was about to expire in early Oct) and I told her that I already applied for extension and yet to get thier response from Vegreville.

Got my extended study permit: Oct 1, 2003

Informed the same to the secreatry of MP: Oct 8, 2003. During this time, I came to know from her that they have opened my file on Oct 1, 2003 and they would be sending medical papers shortly. I was also informed that it would take about six months time to clear all security checks before issuing PR visa (this information was given to secretary of MP by Minster's office).


Change of status in Eclient : Oct 10, 2003 (from "in process" to "decision made")

I am worried in view of the past experience, where I had to receive the refusal letter. As per the secretary (MP) and staff of Minister's office, I am expecting a positive decision from CIC. But, I still have some fear as change of status prior to medicals is quite strange.

I know that you all would tell me to wait for the letetr from Buffalo, but it's my request to you all to guess what could be the decsion in my case in the prevailing situation?


For your information: I have totally 79 points now (recently requested to update my file as I completed 2 years of full time studies in Canada)

Wow! You're going through hell just to stay in Canada. You must be hating the place youre from.

Hi Al,

Going through hell?? yes, it's true. But, hating my place?? not true. Pl remember that all who are immigrating to Canada do not hate their motherlands. There are so many reasons for the people to immigrate. I am not countering your statement, but at least in my case it is not true. I love my country very much.

We have all seen from posts on this group that "Decision Made" can be any
type of decision - not just the final decision.
Maybe they made an assessment decision in your case and would now initiate
security/background checks and mail out the medical forms.

It could also be a decision made about your interview - either waiver or
required.

That would start the next stage of processing for your case.

Sorry, there isn't a lot I can say other than wait for the notification
letter from Buffalo.

If you are getting the points you mentioned and your application package was
complete, there shouldn't be a reason to deny the application so early in
the process.

Thanks for your reply. As you said, I would wait for the letter from Buffalo. I believe that it is a positive decision. Because, I too feel that there is no reason to refuse my case at this point of time, as I meet their requrements under both old and new law. Anyway, I will update this post as soon as I get the letter from them.
