Default Common Law or Conjugal

Hi Again

My second post now...plenty more to come I am sure!!

Started filling in the application forms but am a little unsure as to wheather we should be applying under conjugal status or common-law.

I am English - he is Canadian, both living here in England. We have been together for 2.5 years, we have been living together continuously in either Canada or England the whole time apart from three six week breaks when he went back to Canada, or I came back to England. Although we have been in the same flat in London for about 10 months now, we have not had a continual 12 months together due to theses breaks.

How will this affect our application - does it have to be 12 months continual or will this still count??

We are really hoping to head to Canada around Xmas - am I being over optimistic? Could I still visit for Xmas if the PR is not yet received or do I have to stay put in England??

So many questions......

Conjugal will not work for you if you read the definition. If you are not to marry then you should apply as common-law spouses. You will need to prove that you have lived together through such things as common leases, telephone bills etc.
