Default Australian Immigration to Canada from US

I've done a little research on my question, but I've found other
responses on this newsgroup to be much quicker (at times), so I'm going
to try this avenue.

I'm an Australian currently attending college in the US. I've respected
all the laws of the US in relation to my immigration status here,
however feel that my options for staying in the US after my studies may
not be the best solution for me.

I have a life partner (male) and he is a US Citizen. He currently
supplements my income from my on-campus employment so that I can
continue with my schooling.

I have approx. twelve months remaining on my degree, and I could
continue onto university, but I've been thinking that I could also do
this in Canada, and provide an opportunity to validate legally my
relationship through changes currently being undertaken in Canada, as
well as have the opportunity to work (I plan to run my own business).

My question is this. Can I apply for permanent residence to Canada
whilst completing my college education in the US, or do I have to apply
for that in Australia? If I get permanent residence in Canada, can my
partner retain his citizenship with the US, or would he have to apply as
my same-sex partner?

I know these are newbie types of questions, but I appreciate any
advice/assistance some experienced readers out there may have to offer.

Regards,
James

If you are legally resident in the USA, you can apply from the USA.
However, you most likely would not be able to apply for PR straight away -
student visa may be your best bet.

If you were to be looking to both live in Canada as a couple, this would
be a tougher application for both of you from the get-go. However,
theoretically, you could apply, get PR, then sponsor him. This would take
quite some time though, possibly 3-5 years or more.

Your best bet would likely be to apply for residence in the USA, or
apply to sponsor him in Oz.

First of all - if you are still in the college then it is rather unlikely
that you qualify for Canadian immigration at this time. So, asking where to
apply may be absolutely irrelevant. If you are living together as common-law
partners for at least 12 months then your partner may be included in the
application - the one of you two who has better qualifications will be the
principal applicant, while the other one will be a dependent common-law
partner.

Your partner will not lose his US citizenship after becoming Canadian PR, he
will not lose it even after becoming a Canadian citizen.

You may contact me directly for free evaluation of your chances and
available options.
