now_what is an unknown quantity at this point

under what conditiions does Canada grant asylum to foreign citizens? Will you consider their policy towards granting asylum liberal or conservative?

Educated Indians who have lived and worked in the US and who meet the requirements for migration to other countries probably not so much. I'm thinking Canada's asylum laws are put in place to accept refugees, not those who simply wish to live somewhere else.

Definitions

You may find the following definitions useful as you learn more about refugee claims in Canada.

Convention Refugee

Convention refugees are people who are outside their home country or the country where they normally live, and who are unwilling to return because of a well-founded fear of persecution based on:

religion
political opinion
nationality or
membership in a particular social group, such as women or people of a particular sexual orientation.

Person in need of protection

A person in need of protection is a person in Canada whose removal to their home country or country where they normally live would subject them personally to:

a danger of torture;
a risk to their life; or
a risk of cruel and unusual treatment or punishment.

So as you are back in India, you don't the definition

You would have to apply under the source country definition. See: http://www.cic.gc.ca/english/refugee...ide/source.asp The only designated countries are:

If you live in one of the following countries, you can apply directly for resettlement to Canada. Contact the Canadian visa office serving your region. The name of your office links to its contact information.

If a person is visiting Canada (as a student or tourist), can he apply for asylum when he is admitted to Canada? I will agree that my fear for things happening here is probably unfound, but although India is a democracy, getting a fair trial for something is not an easy task here. Some trials can go on for decades while the defendent is imprisoned and on acquittal you cannot expect the government to reimburse you for the time lost.
