Default arranged employment points, Andrew and other experts on this, pls advise :)

Hi, I filed my CA PR last Oct. and at that time I held a work permit
under graduate category witch was up to Jun. 2002. I renewed my work
permit before it expired under spouse category which will be valid
till Feb. 2004. I have been working in the same software company since
I started. According to CIC page description below

    >You are currently working in Canada on a temporary work visa

    >Conditions:

    >Your work permit will be valid for 12 or more months after you apply

should I get the 10 points? As my understanding, temporary work visa=
work permit(not necesarily HRDC validated as long as it's issued and
valid)

BTW, I already updated my current working stauts (job offer, work
permit)by fax to bufflo case center.

No, you are not eligible for 10 points as your employment is not an arranged
employment and never was. Post-graduate and spouse of a student work permits
don't qualify as they are not HRDC validated at all (including sectoral and
blanket validations) - they are simply validation exempt limited work permits.
You should have applied for regular work permit after obtaining HRDC
validation - then it would be a different story.

Mr Miller,
What about 10 points eligibility in such situation:
One has a HRDC validation exempt post-graduate permit, so legally can
work for a company but according to your previous post is not eligible
for 10 points.
Assuming that the company is willing to offer a permanent job after a
post-grad permit is expired. Is it enough for the employer to apply for
a HRDC opinion or does have to be validation process.?
The person is not going to take this position before PR is granted?

It is not enough - work permit issued after offer has been validated by HRDC
(including sectoral validations) must be valid for at least 12 months beyond PR
application date in order to be eligible for 10 points. As far as HRDC opinion
goes - it applies only to those who are outside Canada and don't have any
intention to work here prior to becoming permanent residents.

Mr Miller, Thank you for your clarification.
Than, It seems to me that in case of validation exempt work permit
holders (even longer than 12 months)the only way to obtain 10 points is
to have an employer seek a confirmation of offer of employment on a
temporary basis.
Or If One leaves Canada then an opinion should be enough.
Am I right, Mr Miller?

As far as the first part of your post goes - it will have to be a different job
offer entirely. The one which was validation exempt will not be accepted.

As for your second question - yes, in such case an opinion will be fine.

I am a little bit confused. I have an open work permit (not validated)
under a spouse of a student case and currently work for a company. What
do you mean by a different job offer? Is it not enough to obtain
validation for that work?

What I meant was for example a post-doctoral fellowship which is limited in
time contract and as such cannot be "re-used" for new validation. But in your
case you'll need a standard job offer validated by HRDC, then you'll have to
obtain new work permit on that basis valid for at least 12 months beyond PR
application date. Validation alone will not work - it will have to be entirely
new work permit.

Dear Mr Miller
Regulations say that: 10 points are awarded if "You have a Human
Resources Development Canada (HRDC) confirmed offer of permanent
employment".
However in company in which I work now emploees (including me) are
employed on contracts which are renewed every three years.
Is that enough for 10 points in arranged employment category.

Looks like you are taking things out of context just to fit your idea - it
doesn't work that way, sorry.

If you are already working in Canada then in order to get 10 points for
arranged employment your work permit must be issued pursuant to R82(2)(a) after
job offer was validated by HRDC (including sectoral validation) or was issued
pursuant to R82(2)(b) on the basis of international agreements (NAFTA, GATS,
etc.) or in a significant benefit category (for example intra-company
transferee). No other work permit (validation exempt) will do, period.

But if you are not in Canada then you will get 10 points for HRDC approved
(opinion) pursuant to R82(2)(c) job offer to employ you on indeterminate basis
after you become a PR.

Length of contracts in the company you work is irrelevant - validity of work
permit and pursuant to which part of Regulations it was granted only counts.

Why it is so hard to understand?
