Applying for Family Class as Conjugal Partners Status
Hi all,
I have read the application kit for sponsoring someone as a Conjugal
Partner under the family class and I have some questions.
First off...How does Canadian Immigration calculate the required year
long duration of a relationship? Is it from the actual date of the
first meeting the person in the flesh? Or can and do they also consider
when the actual relationship began, even if it started "online" where
communication was in the form of emails, phone conversations and chat
messenger programs?
Just a note to the above, I have kept all documentation of our "online"
relationship in the forms of messaging text, some phone bills and emails
as evidence. Also...I know Canadian Immigration want the applicants to
show proof of the relationship when my boyfriend was here in Canada..he
did meet family and friends, there are photographs of us here, boarding
passes from the airplane, receipts from outings, ect...
Secondly...I know Canadian Immigration asks for all the necessary
employment and educational history from both partners on the application
form... on my end as my boyfriend's sponsor, everything is excellent
...I have 5 years of post secondary education...I have been employed at
the same company for over 2 years...I make a very decent income...have
company health benefits, have an excellent credit history and I rent my
own apartment...
my boyfriend on the other hand, does NOT have his highschool diploma and
his Employment history is very minimal, he is only 21 and just starting
out in the work force...Would Canadian Immigration hold this against him
when we apply? Eventhough with me sponsoring him, my employment and
education history is in good standing? Just curious about that.
Finally...I don't know if his nationality would help with the acceptance
of the application....my boyfriend was born in the States and is a legal
American Citizen and he does speak, write and read perfect english, I
was born in the U.K, but I became a legal Canadian Citizen in 1990.

Hi Elaine,
A word of warning for conjugal relationship class. It is not as easy as it seems. You will need to prove strong interdependencey and a "marriage-like" relationship. In other words, they want joint property, bank accounts, wills, life insurance, etc etc. You will need to prove why you haven't resided or married your partner, and there must be a strong immigration barrier. Not being from the same counrty or wanting to marry later isn't good enough.
Myself and my partner along with several other couples lately have been rejected as conjugals. We were told we have the ability to marry therefore we have to and should have done before applying. Some have had there cases left open to "solve" the problem (UK mostly). Others have had it shut and been told to re-apply.
Unless you have strong concrete reasons why you haven't lived together or maried I suggest waiting until you establish a common-law relationship (live together for 1 year) or marry. Otherwise you may be wasting your time.
If you go ahead to apply, as long as your bf is clear of convictions and provides a full history, it shouldn't matter what work he's done. His assessment is based on your relationship and his background history (criminal activity) and doesn't depend on where he is from.

Thanks Sara Ann...ya..I think our best bet is to apply for TRV's and I'll
just have to support the both of us for the year and then apply as Common Law
