Advice required for UK app'n where wife works for a Canadian company in the UK

Default Advice required for UK app'n where wife works for a Canadian company in the UK

Hi,

Myself & my wife wish to emmigrate to BC. Currently my wife works for
Bombardier, the Canadian transport company. She is exploring the
possibilities of an internal transfer to a Canadian division but this
could take some time for an opportunity to arise (if at all & if she
were released from her current position). However, we both get 73pts
taking into account our education, language and experience etc and
both our professional occupations (Electrical Engineer (railway
locomotives) & Engineering Manager (food manufacture)) are listed on
the NOC and we both fulfill the requirements of the job descriptions.
We have funds banked and are home owners with no dependants.

I'd be grateful if you could answer the following questions :
1 - Which is the best way to go, wait for a possible opportunity to
come up for my wife or proceed with a personal application even though
we have less than the 75 pass mark ?

2 - Would our application be rejected even though we could demonstrate
funds of approx cdn$72k without selling our house. If we did sell, it
would release an additional cnd$190k. We are both professional
engineers with 10yrs+ experience each in our respective fields.

3 - If we proceeded with a personal application and it were
unsucessful would this have a negative effect on any possible internal
transfers for my wife ?

4 - What level of french is regarded as basic ?

Any advise would be most appreciated...

You didn't provide enough information to even guess what your chances may be
for discretionary approval with less than 75 points. More - you will need
professional advice and/or assistance to have any chance for such approval,
so "don't try it at home"... :-)

Once your immigration application is refused then it will be almost
impossible to get any non-immigrant visa or permit.

As for French - to get 2 points for basic French you need to provide TEF
test results on at least level 3.

breakdown of how we arrived at the 73pts and do you require any

Here is a breakdown of how we scored based on my wife as the primary
applicant:

Factor Score Reason
1 10 Age 34
2 22 Beng in Electrical Engineering & 15yrs education
3 16 Max for Enginsh & 0 for French
4 21 Worked in current pos'n for 6+ yrs
5 0
6 4 I have a HND in Electrocal/Electronic Eng & 15yrs
education

Total 73pts

Obviously if she were to secure an internal transfer to a Canadian
division of her company she would receive an additional 10pts in
factor 5 and 5 in factor 6, giving a total of 88pts. This is obviously
our pref option as her company would also pay all fees and provide a
relocation package for us. However this is reliant on her securing a
position.

With regards to our professions, my wife works for Bombardier
Transport UK, who are a division of Bombardier inc, (who happened to
make the sky train in Vancouver), she is an Electrical Intergration
Engineer working on FMEA projects at present and has been working in
the UK railway industry since leaving school. She served a 4yr
apprenticeship and subsequently followed part time education sponsered
by her employer, this lead to her receiving her Beng.

I an an engineering Manager for a UK food manufacturing company, I am
responsible for a medium sized factory (cdn$16.8m turnover) and am
responsible for all site plant, buildings, maintenance & projects etc.
I have a team of 6 engineers working for me 24/7. I have a HND in
Electrical/Electronic Eng and a Certificate in Management. Both I
believe are highschool degree equiv. and both were awarded by the
University of Derby. I have been working in engineering since leaving
school and studying part time with employer sponsorship.

As previously stated we have adequate funds at immediate disposal with
more available on the sale of our house. This is valued at approx
cdn$276k and we currently owe cdn$96k, thus available equity of
cdn$180k.

We have visited Canada on a number of occassions, the most recent in
Sept '02 when we spent 2 weeks in Vancouver, previously to that we
have visited Whistler twice & Lake Louise once.

As you noted in your previous post, if we were not sucessful if a
personal application this would prevent my wife obtaining an
inter-division transfer but if personal applications are taking
18-24mths to process this could mean a significantly longer time for a
decision if we try to get a transfer for say, 18mths and then try for
a personal application. so, we are in a catch 22 situation, either
wait, try the work route first and then the personal or do both at the
same time to cut the waiting time but possibly jepodise a work option
it it were not sucessful and this was completed first.

Which do you think is the best route to go ?

We will be in Whistler in a weeks time and could take time out from
snowboarding to have a meeting to discuss this further if you feel it
would be an advantage.
