Default Addressed to Mr.Miller : Family based PR question....

Dear Mr.Miller:

If you don't mind, can you please advise me :

A couple of days ago, I received the initial assessment for my PR
application through Buffalo (with an interview waiver, for now, and
request for some additional documents). My plan is to go back to
India in the very near future and wait for the PR process to complete.
I now am faced with the question of when I should marry my girlfriend
(back in India) so that I may get her PR process started too.

Would it be faster and easier to wait to marry till I get my PR and
then go with family based sponsorship for her ? Or will it be more
preferable to marry before the LP comes and simply add her
information+documents to my pending application ?

Both routes are flexible for me, but I'm trying to plan out my future
based on which one route is generally more preferred and the pros and
cons of each.

Please guide me.

Thank you very much,
Regards.

It is your choice - you may go to India now, marry quickly your fiancée and add
her application to your case or wait for your visa, land in Canada and then go
to India, marry her and start sponsorship process after returning to Canada.
Both ways are OK and pros and cons really depend from your preferences only.
Just remember not to change marital status after visa is issued but before
landing.

Hi Mr.Miller,
Thank you for the information.
May I please ask you a couple of follow-up questions that come to my
mind:

1) If I get married now and add my wife to my application,
approximately how much additional delay (just roughly from previous
cases) can we expect before we get our landing papers ? Will the case
still be processed under Buffalo jurisdiction even though I'm waiting
for the LP in India after marriage ?

2) If I opt for landing first and then marrying, will I need to stay
in Canada and show income from a source within Canada for sponsoring
her or will a bank letter (with sufficient funds) be enough ? Also,
approximately how long would it take (again just an approximate
average range of time) for her to get her PR, if we go this route ?

I'm basically trying to assess which of these two options would be
relatively faster in the long run.

I do appreciate all your advice. Thanks so much !

Regards...

Timeline:

Case Via Buffalo.

App received - 10/15/2001
AOR issued - 11/15/2001
Initial assessment - 10/24/2002

Interview waiver (for now)

Additional documents required - fresh FBI clearance, W2, pay stub,
certified reference letter from current employer, updated bank
letter(s).
Medicals - advised to get done after 6 months from now.

Hope that answers it...

1) Change of residential address will not affect the venue - your case will
still be processed in Buffalo. How much time will be added? It depends from how
soon you'll get married, how soon you'll add your wife's application to yours,
etc. If by that time your case will be at the end of the process (after
medicals and background/security check) then you may expect additional delay of
3 to 6+ months.

2) You need to reside in Canada in order to sponsor anyone - although when
sponsoring a spouse you don't need to meet minimum income requirement. But you
must reside in Canada. Process will take anywhere from 6 to 9+ months.
