2/5 year rule : IMM1000 status after Dec 31 2003: Experts please help

Default 2/5 year rule : IMM1000 status after Dec 31 2003: Experts please help

I landed in Nov 2001 completed SIN etc, stayed for 3 weeks, then moved out of Canada
with family. Again entered April 2002 settled family: rented house, children in
school, bank a/c, credit/debit cards, driving licence : all done and self came back
to join work after spending 3 weeks in Canada.

Question:
1. I intend to return to Canada in Nov 2002 and spend 3 weeks and come out again.
Will there be a problem in entering? Will I be asked for RRP?

2. Assuming all goes fine at Question 1. Will my IM 1000 be stamped "not valid after
six months"?. Understand that after Dec 2003 I will need a PR card to enter and
travel out. Please clarify. Thanks.

Please note I do not have any USA PR visa and will not be entering Canada via the US.

1. No, you shouldn't have any problems entering Canada in November as new law saved
your PR status which may have been already lost under the old law. Under new law
there is no RRP anymore.

2. No, your IMM 1000 will not be stamped but will not be valid for travel after
December of 2003. You need to apply for PR Card while in Canada and pick it up in
person when issued - without valid PR Card you won't be able to board a Canada
bound plane after December 2003. PR Card will have to be renewed every 5 years and
you will have to provide proof of meeting residency obligation when applying.

Hello experts,

My question is as follow;

My friend landed in canada in July 2001 , exit canada in may 2002, now how long can
he stay out of canada , 6 months or 2 years.

Up to the total of 3 years between July 2001 and July 2006, so he should return not
later than April/May 2005 and stay put in order to make up for the rest of 730 days
in Canada before July of 2006. But he may not be able to return after the end of 2003
without a PR Card and such can only be applied for and picked up in person inside
Canada. PR Card cannot be applied for nor delivered outside Canada.

Will the original poster going to have problems getting the PR card or applying for Citizenship upon breaking the old rule?

How long does it take to get the PR card? I've got my PR status and was intending landing in a couple of weeks time. I intend to get the initial formalities done and then come back to tie up any lose ends, house, etc, before going back permanently next summer.
