I haven't formed a company as yet or done any of the other things you're supposed to as I wasn't convinced this would ever happen but it looks like I need to get started!

Patchsidhu, with all the confusion going on with the panchayat's (specially the south Goa ones - Benaulim/Colva), I would be very interested to know if indeed you get your letters in the next couple of weeks. Has your developer confirmed receiving the occupancy certificate ? if not then i would not count on getting your possession letters till that happens. We too have been getting similar assurances since June of this year and though the construction at our development in Benaulim is complete, the developer is having trouble getting the occupancy certificate from the Benaulim panchayat due to intimidation by the villagers of benaulim who are against any form of 'development' .. would you please share with us the status (receiving occupation cert / possession letters) so that others who are in this situation know what is going on. cheers

Yes, I'd be interested to know that too. A couple of accquaintances of mine were told by their developer in mid-April that he would have the Occupancy Certificate AND/OR No Objection Certificate within 4 to 6 weeks & guess what, it's now 6 MONTHS later & the developer STILL hasn't got the O.C and/or N.O.C. - 1st it was because the man from the Panchayat (Saparnach?) was away on business, now it's because the developer has to finish the swimming pool (:eek: - what difference the pool makes to the development being habitable the couple can't quite work out!) before the panchayat will issue the O.C. and/or N.O.C. - interestingly the panchayat is near the above mentioned panchayats of Benaulim & colva - I suspect there's a link. . . . . . . . . . .

Okay I follow all that I think although I'm confused by the contrary opinions on different forums,press articles etc.

However,as there seem to be a lot of us in the same boat,have a group of you got a Solicitor working on a possible solution? If not I'll instruct mine straight away but I don't want to set the ball rolling if it's already moving.

Dread you mentioned Lewis Belworth - who is he/they?

Hi Jeff

I appreciate it's a bit scary, especially when you move around different sites and get different views etc. All I can say is that I for one, and several of the others here are giving advice to help you avoid being in the same mire we have found ourselves in with setting up companies etc.

Lewis Belworth is a site member here, and if you go to the Save Goa poll thread, you will see that action is being taken.
I will pm you, and also ask Lewis to pm you, because I think you can benefit from it.

For the record I can fully vouch for Lewis integrity

South Goa Developments - Benaulim
 
I happened to come across this article in the Times of India about a development in Benaulim having received their occupancy certificate. Hoping it was our development (Micon Coastal Paradise) I got in touch with the developer and staff at his office confirmed that it was indeed the same development - so people at this development should (hopefully ) be getting their possession letters at last.. :fingerscrossed: (and toes) crossed

Take a look at the article below that one entitled "Govt plan to cut documentation for certificates" - and the promise from some Govt department in Panjim to 'root out corruption' and stop the paying of commission to touts and agents.
So looking forward to a post from J5 on that one !

Sorry for not geting back sooner, I was hoping that by now I should have recieved the Occupany cert and would let you guys know.
But alas I am still waiting, i am flying out to Goa in December so hoping that if Coastal Paradise got there's our might be a formality?

i believe that till something happens - it has'nt happened - specially in india.
though the newspapers have reported 'statutory approvals ' for granting the Occupation Certificate for Coastal Paradise and while the developers office has said they should get the actual certificate sometime this week , and we , our possession letters this month :fingerscrossed:, i will not count my chickens till they hatch - when i receive the actual document confirming this I will share it here. hopefully, the positive outcome of this (if it does happen as per the early forecast) will set a precedent for Sears Exotica and other developments in the Benaulim/Varca/Colva area. I know this sounds a tad pessimistic, but after reading what so many people in Goa are going through with their property problems, I cant feel anything but that..
I hope that this property fiasco gets over for all , and in particular for people whose life savings are involved..
