Re: Sears Exotica
Hi PatchSidhu.
I spoke to the developer about a month ago and he told me the same thing. He also said the same 6 months ago so I wouldn't hold your breath. If you want his phone number let me know. Cheers, Jeff |

Would it not be an NOC (no objection certificate) that the developer is waiting for? These are issued by the panchayat as far as I am aware - which panchayat does your development fall under the jurisdiction of? I'm led to believe that some are slower than others & some are more awkward than others, particularly is the Saparnach knows that the 'political allegiances' of the builder/developer are different to their own. . . . . . . . ya catchin' ma drift?
H. Sorry for the delay in thanking you but my work computer wouldn't let me send any mail. I think I will just have to sit and wait it out, luckily I have a home in Danika residency. I think the Panchayat is in Colva and it probably is the NOC that they are waiting for. Thanks:thumbsup: Patchsidhu |

Re: Sears Exotica
Hi Patch - don't kmow your real name!
Good news at last! I guess the letter will include a demand for the balance of the purchase price. I haven't formed a company as yet or done any of the other things you're supposed to as I wasn't convinced this would ever happen but it looks like I need to get started! Let me know what you find when you get out there and I expect to come out in the new year so hopefully we can get together. Cheers, Jeff |

Re: Sears Exotica
Andy,
Thanks but it's too late for that as the apartment is 90% paid for! John, As far as I'm aware that's compulsory for a foreigner but doesn't necessarily make it legal! Cheers. |

I am afraid you cannot set up the company retrospectively the sales agreement has to be set up on a business visa not a tourist visa and as you apparently didn't have on this is a major problem ! How have you paid for the 90% ? Do you have FIRC documents etc etc etc ? The business route like all routes on buying in Goa is closed so I am sorry it looks like you quite possibly have lost your money.( And will waste more) Is there any way your builder will legally refund your money ? I am sorry to give you this bad news but as a_f_d advised you please read "Buyer Beware" Thoroughly Please also see the "Save Goa" poll and send Lewis you story also send your story to the address posted by Helene in time for Thursdays meeting K-C |

The Goan Govt has made it very clear that no deeds of sale will be issues to foreigners, whether they have fulfilled residency requirements or whether via a companmy with foreign directors. You are one of many in this situation, we have all been misled by agents, builders and advocates, and all of us appear to be in the positions of being threatened with confiscation by the Directorate of Enforcement, or bound by agreement of sale only. I would strongly advise you to contact Lewis Belworth by pm as there is something being done to help US ALL, but this needs to be kept from open site for obvious reasons, which he will explain to you. This pm will be in confidence and you have nothing to lose, but much to gain. You have my empathy. Dread x |

I cannot believe that this behavior is STILL going on.:thumbdown: Jeff, I set up a business after the 'purchase' had gone through. It cost me a lot of money and then some and it still is. It is utterly worthless as the builder simply says that the agreement was with me not the company and he is probably right on that one. It would be very difficult to prove otherwise!!! BE VERY VERY CAREFUL. I am not aware that it is compulsory to open a business. The builder and his 'friendly advocate' chum may well tell you that it is just to make some more money. You may be able to get your money back if you have not paid it all as some more reasonable builders are trying to get out of involvement with FNs due to the publicity this scam is now receiving. Good luck and take heed of the advice to read the Buyer Beware thread. Daff |
