ANYONE ON S1 WITH ESA AND INDUSTRIAL INJURY BENEFIT??????
Hi Everyone
We have been researching this health problem now for 3 months and cant find a definitive answer?
Is there anyone out there living in France who is in receipt of Contributions-based ESA and Industrial Injury Benefit who has successfully obtained an S1 on the new system ?
The law seems to say that S1's are available for people who would have been on the old Incapacity benefit but we cant find this stated anywhere on a gov/uk site.
Also what happens after 30 months when the S1 expires? Do you get private health cover for the period up to when you've been there for 5 years and can join the French system?

Peter, My advice wold be to take instruction directly from DWP and the NHS. But make sure that you get it in writing.
You are clearly talking about a very restricted and specialist area of healthcover, and one you need definte information on. Most of us here can only really answer for our own circumstances.
As you are aware, the rules have changed and nobody - not the DWP, the NHS nor HMRC will give you the same answers.
Newcastle have some sort of switchboard system, whereby although you may have rung Overseas Healthcare, you can find yourself talking to a member of HMRC or DWP or the NHS. Or any variation thereon. The rules and procedures seem to be different for each, so it is very important to establish exactly who is talking to you at all times. Then confirm everything in writing with a named person.

As said on another thread, there isn't really a 'new system', just that the S1 that used to be granted to early retirees for a fixed period, based on contributions in previous years, has been withdrawn.
S1s for workers and those who receive age pensions and certain other benefits from the UK govt have not been withdrawn, not all were time limited and if they weren't before they won't be now. However the tendency seems for the UK to tighten up as much as it can, but that said, it has to comply with EU law.
You need to hammer it out with DWP because the devil is in the detail, they look at your individual circumstances, so the fact that someone else has got it doesn't necessarily mean that you will, and the fact that someone else was refused likewise does not necessarily mean that you won't be successful.
Try googling 'exportable benefits', it should be there somewhere.
