Default Spanish Wills - or Not?

High Folks,

A group of us have just purchased a property in Spain that we are going to be renting out to holiday makers. We have received conflicting advice from Lawyers about whether we should have Spanish wills or not. We are all resident in the UK and have UK wills. Nobody seems to be able to give us a compelling reason why we should have Spanish wills as well. Can anyone help.

IMHO If you have anything in Spain you need a Spanish will to cover it, English wills are no good in Spain, they will not be accepted for the beneficiary if you die.

Default Spanish Wills

You have been given VERY BAD advice by your lawer!

You really MUST make a Spanish will because, although Spain will accept a European will, it's not accepted in Spanish law if there are problems and it costs very little to make a will in Spain.

In addition, in Spain, your Notary retains the original and the whereabouts is recorded in Madrid, so there is no problem locating the latest one, unlike UK where it's a lottery to find it!

PLEASE PLEASE PLEASE make a Spanish will, and change your lawer NOW!

p.s. I am not in the legal profession, just hate seeing a good guy seen off by a poorly briefed con in Spain.
