Power Of Attorney
It has recently come to light that uncertified Powers of Attorney, have been used to obtain mortgages. If the documentation has not been legally processed and certified, under Cyprus Laws, the mortgage may be declared null and void.
There are reports that banks that did not check the validity of the Power of Attorney, are chasing purchasers for mortgage arrears, threatening court action.
The Certifying Officer must follow certain legal procedures, and if these are not followed, the Power Of Attorney can be declared not valid.
If you are in arrears with your mortgage, then it might be a good idea to check your documents, especially a Power Of Attorney to see if the procedures have been followed.
I would suggest obtaining legal advice to confirm the above to, as there are apparently some reports of some cases proceeding in Paphos.
