U.K. passport application denied
Hi all just wondering if anyone else has been in a similar situation and can offer advice
I was born in the Middle East in early 80s (But British by descent). My parents both U.K. citizens and were born in the U.K. and moved to the middle east in late 70s to work.
I recently married to a non U.K. citizen. Baby born In UAE.
trried to apply for U.K. passport but gets rejected on the basis that Citizenship only gets carried down once if ‘by descent’
thankfully wife is likely to be able to get the baby a passport from her nationality/embassy.
but is there anyone who’s been in a situation similar? If it weren’t for my wife, baby would be stateless! As certainly wouldn’t be able to get citizenship in the UAE!
Next step is to work with the home office but not sure where to start. Any advice appreciated. The trouble with a second Generation Middle East expat!!

The situation is common, a reflection on one of many inhumane aspects of British Nationality Law.

Your child would not be stateless but as the second generation born overseas they are not automatically a British citizen. Did you ever spend three consecutive years in the UK before the baby was born? Which nationality is your wife?

yes I did for university. Wife is US Citizen

This rule has been in force for many years...... YOU were born outside of UK and now your child has also....... The US also has rules as to who obtains US citizenship based on whether parent has spent enough time in the US once passed a certain age.

Okay, so if you spent three consecutive years in the UK you can register your child as a British citizen now under S.3(2) BNA 1981. Bear in mind that if you arrived in September and left in June three years later then you’ll be three months. If you meet the criteria then your son or daughter will receive British citizenship by descent. This is fixed and your grandchildren will not be able to be registered in the same manner.
If you don’t meet the three year requirement or would prefer your child to have British citizenship otherwise than by descent you can wait until you return to the UK as a family and obtain a child visa in their US passport. After three years you can register them as a British citizen under S.3(5) BNA 1981. This means their own children will automatically receive British citizenship regardless of where they are born.
