My son's Chinese fiance was refused her UK visa in June due to insufficient evidence (copies instead of originals sent and she did not do the medical test). They have reapplied this October so they can get married in the uk and live here, this time submitting original copies are completing the medical test. The previous application showed bank records that indicated transfer of money from China to his UK bank account, because she is selling goods to China from the UK using a wechat app, getting paid and transferring money to his account in the UK so he can purchase the goods and post to China. She was doing the buying, packing and posting when she was over on visitor visas. Now he is going this on top of his normal job. The new application hides this information (not showing on bank records) and does not indicate her online business as the cover letter in the refused application did. It did not mention the exact nature of the online business.
If they compare the application, there will be a problem. Do officials just look at the reasons for refusal, then administer the fresh application, or do they actually compare all the paperwork? Anyone had experience of this or know how an immigration officer does this role ? Thank you (worried parent)

Yes, the new application will be scrutinized based on the fact that she had an earlier refusal for spouse visa.

I must admit that I don't understand how she was, apparently, refused for not providing original documents or not undertaking the medical test, when the financial requirements -which had to be based on your son's income and financial records - appear to have been fulfilled by his fiance running a business in the UK while on a visitor visa!

If the original application was based on him receiving money from her to achieve the 18,600 GBP per annum, then, if this is now not the case, you will have to show additional evidence of how his income is achieved.

Thank you for replying. I didnt make it clear. Both applications cited his income which is above the minimum required. It's just that the first application alluded to the fact that she had an online business (in their covering letter), to show they were financially secure. They have since been advised not to mention the fact she has been working while on a visitor visa at all, so no reference has been made to this in their new appolication and they've waited some months before reapplying while they ensured no money was showing as coiming from China into his UK bank account. The visa was refused because instead of sending original documentation as required, they sent scanned copies and she forgot to get the medical test done and show evidence she had passed the English test (a dog's dinner basically). So, are you saying the two applications will be compared and scrutinised more carefully due to the refusakl even if the admin bits that were incorrect last time have been attended to? I'm concerned that if they compare the covering letter and definitekly the bank statements (the first showing amounts of money for purchases and money transfers from China) that it willl be obvious she has been working.

If the refusal letter stated that her refusal was due to copies of documents and the medical test and nothing else then one can "assume" that the online job of the applicant was not taken into consideration.

You can only apply again, without reference to the online work.
