Default Getting a British passport?

Not long have we got my PR, we are already thinking about moving to the UK at the end of this year.

I'm british, husband is Canadian. His Dad is british, but no longer has a british passport.

What are my husbands options? He can obviously get an ancestry visa, but could he get a british passport because of his Dad at all?

Also what are his options through me?

If his father is British I'd imagine he qualifies by descent.

I would suggest your husband is British by descent and should first register as a British citizen, then apply for a British passport.

No need for visas or you sponsoring him. It should make no difference to your husband status that his father no longer has a British passport.

Your husband could be a UKC by descent (if his father isn't a UKC by descent). If so, he just needs to apply for a UK passport. He'll need a full birth cert (one that gives parental details) and his father's full UK birth cert.

I know where you are going with this. For the purposes of my response I was assuming the father was born in the UK therefore the son is British by descent.

If the father was not born in the UK, and he himself was British by descent, then that will be another matter as to the sons nationality. There are exceptions to that though.

His dad was born and raised in the uk. It's gonna be a way easy process for him than it has been for me!

Then it's safe to assume your husband is British, by descent, and you simply need to follow up with documentation to register his British citizenship and apply for a British passport

Except that you don't "register" British citizenship if it was automatically acquired at birth.

It can be evidenced by consular birth registration (not available in Canada) and/or applying for a British passport. Or a Right of Abode stamp in a Canadian passport.

He just needs to apply for his British Passport with the required documents as has been stated, then whenevver you are ready you can just move over here, no visas, no financial requirements, just turn up.
