Default Accommodation Requirement for Spouse Visa

My wife will be applying for a UK spouse visa to accompany myself (British Citizen) and our British citizen children back to the UK next year after a long time living overseas. On the accommodation side I do own a house in the UK and it is currently rented out. We would intend to give notice to the current tenants so that the house is available for our own use as soon as we get back. However when the spouse visa application is actually made six months in advance it would still be tenanted. Is this likely to cause any problems for the the granting of the Spouse Visa?

No, so long as the house will be available for your family’s exclusive use as of your proposed arrival date.

Thanks very much. Would the Home Office expect to see any proof of this such proof of ownership via a Land Registry entry and an accompanying Section 21 notice seeking to terminate the tenancy for example?

The Land Registry documents should be sufficient. As they’ll be gone by the time you arrive I wouldn’t mention the tenants if that question is not explicitly asked.
