Default 2 year time limit?

I've seen a few references on the boards about having to return within 2 years, to avoid immigration questions on returning with one way tickets, and stay in the NHS/Dental etc. Can anyone elaborate on this, as I've struggled to find detailed info elsewhere!

areturning from where! On what passport? Are you travelling on a British passport or something else?

The poster may be referring to the forum detailing situations where people who have lived in the UK on various visas but then leave the UK for two years or more are NOT regarded as returning residents because their visas have lapsed (or their Right to Remain status has lapsed).

In these situations the "returnees" are regarded as new immigrants and have to undergo residency rules.

Ok, so maybe I'm getting my wires crossed, and it's not pertaining to our situation. We moved to Canada 18 months ago, and will be returning almost exactly around the 2 year mark, with British passports. So no problem right?

As British citizens, you won't get immigration questions. Not sure about eligibility for benefits though.

If you are referring to returning to the UK then you are correct...there is no problem returning as UK residents as you have UK passports.

im not following the returning in two years tell me this we have been in the US for 12 years we have US passports but we still have our UK passports which are up for renewal this year, and we are returning to the UK next year which passport do I use to go back and will I have a problem with immigration on a 1 way ticket

If you're a British citizen and hold a British passport then you can come and go as you please. Use your US passports to leave the US (it's a legal requirement) and use your British passports to enter the UK.

thanks for that now another question my UK drivers license expires at the end of 2014 when I go back to the UK will I have to take the test again ????
