I can't see it working over here as the costs recovery isn't sufficient. You and I both know that the likes of DAS charge their policyholders a minimal premium (a tenner a year) for such policies. DAS then instruct lawyers on the basis that the lawyer will never make a claim against the policy (the lawyer will limit their fees to the amount they recover from the other side).

If lawyer's ever charged their fees to such policies over here, I suspect the premiums the likes of DAS would have to charge would be prohibitively expensive.

What is required is a complete overhaul of the costs regime.
