Visa/permit advice for remote working
 

Hi,

Any advice as to (a) what I need to apply for, visa/permit-wise and (b) what the tax implications are for my situation, would be very much appreciated.

My situation is as follows:

• My wife is an NHS surgeon and is moving to Canada for 1 year (1 July 2022 - 30 June 2023) as part of a clinical fellowship training programme.
• Although they have not yet been granted, she has already applied for her visa/work permits (she has not included me in any of her paperwork, since I have not yet received clearance from my employer that I can leave).
• I am a lawyer for a firm headquartered in the UK, which does not have any offices in Canada.
• I would like to continue to work for the firm that I work for remotely, full-time.
• We own a property in the UK, which we will move back into upon our return.

I realize this is not an answer to any of your questions but are you going to Toronto? I ask because one of my daughters took up with a surgeon who was here for a year (later extended to two) as part of a clinical fellowship training programme. It would amuse me if it were the same position.

1, As long as the firm has no Canadian base or clients, there is nothing stopping from working remotely.
2. Although it is really moot question, as the spouse of foreign worker in NOC O, A or B, you could get an open spousal work permit on entry to Canada.

Thanks for your help - am I correct in thinking that I therefore only need to apply for a visitor's visa?

And does anybody know about the tax position - it seems that I might be subject to tax in both countries (and I can then claim relief in the UK)?

Yes, except for some obscure cases, a tax treaty applies and one ultimately pays in one country or the other. A return has to be filed in the other country including taxes paid as a deduction.
