What will be the passmarks for an application submitted in Buffalo before Dec 2001 which gets transfered to india in JUly 2002?Will the transferred application be judged against "75" 0r "70" points?

Hi:

If you do not have your application assessed by March 31, 2003, you will be assessed
under the new selection criteria with a pass mark of 70.

If you have your application assessed but no final decision is made by March 31,
2003, you will be assessed under the old selection criteria with a pass mark of 70.

Passmark of 70 under new rules will be applied even if the application is transferred to India( though applied at Buffalo in August 2001)??I am under the impression that It will be considered a fresh application and date of submission at Buffalo wont be considered,hence a full passmark of "75" be applied..Am I wrong?
