Tax allowence/refund on emigrating.
#1
Hi
we are moving over to Canada in May and a couple of tax allowences have come up
1.On emigration a UK tax payer will get their FULL years tax allowence i.e. work up to may/june and you will probobly get an almost tax free wage packet. This may only help if you are not working straight away in Canada as you will be taxed on the reciprocal agreement.
2.If any items are bought in the Uk,the VAT can be reclaimed if the goods are sent straight to your shippers for good to follow. The form from C and E says that the time limit is 3 month prior to moving but our shippers have said this time limit is not really applied.

I would recheck your facts on this one.

Phoned the tax office and was told in essence that
'If you get paid in the financial year that you emigrate you receive a full year's Uk tax allowance not a pro rata allowance'.

I may be wrong but was told by our shippers that any goods <= 6 months old bought in UK are (potentially) subject to duty at Canadian end.
Guess OK if you don't show receipts, but you are suppsoied to show proof of purchase wherever possibel, right ?
Rich.

this is a grey area that i don't really understand.
As far as i can see
1.Any goods bought into Canada less than 6 months old, unless used, could be subject to tax at the Canadian end.
2.Only goods bought in the UK and shipped ouside the EU in the 3 months prior to moving are eligible for a VAT refund.
Therefore in theory any new goods bought in the UK 3-6 months before emigration, not used and shipped to Canada are taxed twice!
Haven't experienced this in practice yet.

But a new product you have used in the UK (or elsewhere) and then bring to canada is deemed to meet the requirements under either 10d or 13, so should be exempt from further taxing as long as its on the GTF list.

However should you sell any new stuff within 12 months of landing it, then you could get hit for the duty on it.

If you're in the spousal/family class i.e. one of you is "returning" to Canada, you're allowed to replace your goods (buy a new telly/computer/whatever) and inport them duty-free before you return, assuming you've been gone more than a year. This may be a good deal if you're coming from Hong Kong but who the heck wants to buy more stuff in Britain?!
