Hello,

I have a question regarding my son's legal status in Canada when he turns 18 next July.
I have a post graduation work permit valid until Sept 26 2020. My son held a Visitor Record while I was studying in Canada and we have applied to extend his Visitor Record this summer. He is currently a Grade 12 student.
Will he be granted an extension to his Visitor Record for the length of my post grad work permit or only until he reaches the age of 18? If he wants to go on to post secondary education here in Canada will he have to apply for a study permit? We have a PR application in process (PNP) right now.

Yes he will be granted an extension as he is still considered a dependent child. If going to University or Post Secondary he would apply like any other student would.
If wanting to work then apply like any other temporary worker.
Until the law changes he is a dependent child as per this for Immigration purposes. Its supposed to go back up to 22.
A child who depends on their parent for financial and other support. A son or daughter is considered a dependant of their parent when the child is:
under 19 years old, and does not have a spouse or partner, or
19 years old or older (also known as an overage dependent child) and has depended largely on the parent’s financial support since before the age of 19 because of a physical or mental condition.

Today is only the 20th Actually good to know. Also Conditional Sentences are no longer considered as being incarcerated and therefore a PR who was given a Conditional Sentence of over 6 months cannot now be deported or considered inadmissible under 36(1)(a) of IRPA. The Tran decision came out yesterday from the Supreme Court.

is it not changing to 21 and under on 10/24 ?

The current definition of a dependent child came into effect on August 1, 2014, and changed the maximum age from “less than 22” to “less than 19” years of age. The proposed regulatory change would return the maximum age to “less than 22”.
