Default Some legal advice please regarding unions.

I wondered if an individual member could take action against their union, if the union does not apply policies and procedures fairly and if so what would be the correct way forward as I have an issue with the BCTF. I would appreciate all help and advice.

Yes, with some provisos (former union official here ).

Is this a complaint related to your local section, or the BCTF as a whole?

If the former, your first port of call would be the Judicial Council of the BCTF.

I'm not a lawyer, so any further advice will depend on your answer to my question above.

Talk to a lawyer. If you do it wrong, you can be paying out a lot of money for nothing and if you lose, you could end up paying their legal bills too.

I'd search Canlii.org (amongst others) for cases where BCTF was the defendant, & look-up the plaintiffs' lawyers in those cases.

In your situation, I might also speak to the BC labour board/workers' rights/whatever it's called out there. If there's an egregious breach of your rights, they *might* engage, otherwise they might be able to direct you to relevant help.
