Default marriage

I am a british citizen who resides in Scotland, UK and looking to emigrate to , Calgary, Canada to be with the mother to my 2 lovely kids.

We both started a relationship back in 1993 here in East Kilbride, Scotland,UK where we both stayed and which we continued until 2004 when we planned to move to Canada we never married, my partner was born in Canada and took out citizenship so this made it possible for her and my two kids to emigrate and I had gained a employment contract with a logistics company in a semi skilled position (forklift driver warehouseman) in Toronto.

My partner and both kids moved to Calgary in September in 2004 as my partner was due to start employment in October and it would give her time to get the kids into schooling. My employment was due to start in January 2005 as I had to get my medical, police checks and to finish my employment here in the UK. I was notified by the Canadian Embassy on December 2004 that my employment would be revoked due to my semi skilled status and that a Canadian could and should fill the position.

Over the years we have tried various routes sponsorship, temporary work visa and trying to gain other skills to improve my employment background but have failed due to the finances required. We have continued over the years to keep in touch and both want to be reunited with each other and spend our life together in Canada.

We have spoke about getting married but only if we could all reside in Canada and not in separate countries. I would be very grateful if anybody could tell me if we married I could stay in Canada legally and could work if anybody could advise me I would be very grateful of any help.

I got to the third line and gave up. Apologies

I think you need to get married and then apply for spousal sponsorship but I could be wrong.

Yep, marriage then Spousal Sponsorship is the obvious visa choice. Have a look at the Wiki and CIC website for info on what your wife and you will need to do.

Good luck.

If you been together for a number of years... living together... wouldn't you be common-law?
if so, you can apply as a common-law... otherwise... Marriage & spousal is the way.

Sorry for asking but you are living apart from each other since September 2004 = 9 years and despite wanting to be together never thought about getting married and sponsored? Spousal sponsorship will get you PR within 6months to a year and the ability to work wherever.

I believe that common law requires that you have been living together continuously for the last 12 months

From what I can chop out of the walloftext above I don't think that is the case

It would appear from OPs first post that they haven't lived together since 2004.

as posted by others & given the nine year time span, if she is agreeable to marry you, then to sponsor you - that would be the way to do it.

Good luck
