Hi there,

I am a B.E., working in United states(under H1 visa) and planning to settle in canada. Also I am planning to get married by this year end. Basically, I am from India and I will marry an Indian girl.

Ok, here are my questions :

1. Can I get married first and then apply for the spouse visa along with my application? or Can I first apply then get married and sponsor my wife for the visa? Which one is best?

2. Suppose, if I get married and then apply for the canadian visa, that time if my wife is in india, what will be time duration to get both our visa? Is it 3 months or 6 months or 1 year!!!!

I hope somebody will understand my question!!!

Thanx in advance,

Cheers,

Depending on the timing of your marriage, it may be possible to either amend your
spouse to your existing application (before landing), or to sponsor her (after
landing). Details on each are available at the following URLs:

http://canadavisa.com/documents/amend.htm

The application process will most likely require approximately 5-6 months if an
interview can be avoided. If an interview is required, the process will likely
require approximately 10-12 months. These estimates assume submission of the case
in the USA.

1. The best would be to include her with your application as your dependant spouse.
You may do it even if you are not married yet as long as you can provide evidence
that you will marry soon and submit marriage certificate later during the
application process.

2. Anywhere between 9 and 15+ months.

Default Spouse Visa

Hi David,

Thanx for your reply. But when I checked the link "http://canadavisa.com/documents/amend.htm" under marriage it says "A fiancé(e) is not included within the definition of an accompanying dependent, and therefore may not be included in the application until the actual marriage has taken place unless there are compelling humanitarian reasons for an exception to be made."

So, the above statement says that even if I have a fiancee I cannot apply for the family class visa along with my application.

Also, I would like to say one more point, see I am planning my marriage as simple as possible... So no photographs..!!! I am going to invite only limited friends and relatives. In this case is it compulsary that I have to proudce photographs along with my marriage certificate or only marriage certificate is enough...

Regards,
