Default Dependant Child Problems

Hello all
My husband and myself are almost ready to send in the documentation, but my son, who is almost 16, hasn't seen his biological father since he was a few months old.
I have a letter stating that I have custody, but my ex- partner has access, although he never used this right, and I have no idea where he is now.
Can we submit the forms without his approval to take my son out of the country? Please Help!
