Default Can I get my duty tax back?

I am a Canadian PR living in Canada
I am travelling overseas to see my family

I bought a mobile through the internet as a gift to take with me

This phone got charged a duty tax from customs.

now that I am taking this phone out of the country in few days (phone still in its original cover)

can I ask for duty refund as the phone is not staying in Canada?

1. Unlikely as it was delivered to you in Canada so duties are charged so how would CBSA know you are exporting it?

Doesn't appear to be a valid reason for a refund - https://www.cbsa-asfc.gc.ca/publicat...6-2-6-eng.html

I asked a similar question a few years ago about a sculpture that I bought for my Mum, it came in from the states and within a day I took it to Europe. The answer was a resounding no.
