Sorry, no replies on immigration forum, so thought I might try some of you who are already in the country


Hello!!

Before any of the Oct applicants have heart attacks, it's not me. I'm still sickenly happy and can't wait to move to Aus next month.

It's my Auntie, in Aus on Defacto visa for one year. Things are not going well and she is talking about moving out. Does not mean that things are over but hey...

1. When does she have to tell immigration department about a change in circumstances? Presumably only if/when she actually moves out?

2. Is it possible to apply for a skilled migration visa (as nurse) while in Aus on a de facto visa? That way she would be safe from being kicked out from the country if things did go all wrong. She is already working in Aus.

I'm just concerned that she's not thinking about the legal/visa side of things at the moment (obviously) and having just been through the application process myself I know that she is reliant on their relationship continuing to be able to remain in Aus as things currently stand.

Has anyone been in this situation and have any advice about what to do (and what order to do it in)??

i dont know the rules for this situation but my advice would be for your aunt to just let immigration know what is happening and get some advise from them. i think they or her migration agent(if she used one) would be the best people to ask.

hope it all works out in your aunts favour.

this is my mates story..he came to australia 20 years ago came on holiday working visa...over stayed got banned for life...got another passport got another visa (while in Argentina) came via south america...got engaged to aussie girl...on defacto....they broke up... admitted it to immigration still got visa ...then married a pommmy girl and she got citizenship through him....

Yes she can apply for a skilled visa whilst here on a de-facto, but she will have to leave for a few days when it's ready to be granted.

I would strongly advise her to get a good agent though

All I will add is that she needs to plan what she's going to do before she notifies the Dept of her changes of circumstances. Once they process the notification she'll only have 28 days, which is a very short time when you're talking about your whole future.

It might take some time for them to actually process it which will give her longer, but then again it might not. How long's a piece of string?

Definitely recommend professional advice from a registered migration agent in a case like this.
