Default pedestrian right of way

Hi,

my wife insists that if a pedestrian walks out into the road they have right of way, basically if you hit them you are in the wrong.......i say no........anyone know the real deal??

Yes they do have the right of way

Ah, but that is Jaywalking which is illegal.

The law is something to the effect that if the pedestrian has one foot on the road then they are/may be about to cross the road, therefore the motorist should take due caution. If the run out of nowhere then they are at fault.

so jaywalking is technically illegal in Australia? So if they blatantly just decide to walk and you hit them...they are at fault..........yes?

I don't know, I'm in the UK

One of the questions I failed my first test here. The question was roughly if your lights show green and you move off, if someone is walking across the road, it is their right of way. It mainly works if you are turning left and the crossing on the road you are turning onto is showing green for the pedestrian. You have to give way.

Didn't word it very well. But generally, if they are crossing, it's their right of way. If they are thick and just step into the road to cross, and you hit them you would still be liable for not taking due care and attention.

Pedestrians always have the right of way on the road...If a driver hits them it becomes a bit tricky in law but they DO technically have the right of way.

my aunt lives in Morcambe, it's a bit boring there isn't it. Everytime I visited it was shut

They may have the right of way.....but doesn't do them much good if they are dead.

Best to check before you step out on the road.....


Does anyone remember the Tufty Club ??

I can't remember where, I haven't seen her for a while. Her name is Maureen but I don't know her surname. She has two kids one called Julie and another called Mark. Julie has now bought a pub somewhere and Mark is in the Army or Navy. She will be in her 60's now.

It's weird that I used to ge see her every year until I was about 25 and know so little about her

In the USA pedestrians have right of way in carparks. They suddenly appear from between parked cars, trolley ahead and not a care in the world.

I wonder how long they would last in Europe?
