Exclamation Could anyone advise on work contracts?

Hi I posted this a while back but thought I would try here and see if anyone could help.
My OH au permanent work contract has a clause where you can be terminated without cause, (with 28 days notice) is this an everyday thing in au? anyone else got this in their contracts ?, it is both ways, it means you can end your contract with 28 days notice, but I have not seen anything like this in a uk contract so am a bit stumped.
Its making us a bit nervous about making the move as it means little job security, we'd be on a 457.
I can cope with the loss of holidays, sick pay, redundancy, etc, but would like a little security, what do you think????????????

Technically in Aus you can be dismissed at any time within your first year although most companies give notice if it's for no other reason than they can't afford you. If your OH contract says 28 days notice then it sounds like this forms part of his individual agreement /contract. Perhaps you want to negotiate a better deal as that is cutting it fine if you need to leave Aus due to them finishing your OH contract earlier than expected.

That's the chance you take on a 457 visa. These visa's are renowned for being the most difficult as basically the employer holds you over a barrel as you give everything up to come here, whilst promising to work for the sponsor for two years.

It has been known that the things promised on a 457 haven't materialized, or things like you don't get a salary increase for the two years you are here etc. I don't want to put you off as plenty of people come on this type of visa so not all employers can be bad, you just need to be aware and factor these things in.

Can you not get here on a skilled visa? That way you are not beholden to any particular employer.

Good luck and all the best for your move over here

When I discussed my 457 awhile ago, I requested that if the employer terminates my contract without a cause, they would be liable for paying me a sum of money, equivalent to a one way economy airfare plus a few other tidbits, and it went down well with them. I ended up not taking the job because of whole other reason, but it goes to say that employers may be amendable to such things.

Agreed, especially if they are sponsoring someone. This implies they need your skills ands can't get them here. Anyway, what has anyone to lose? Contract negoatiation should also include if things go wrong too

Thanks for your comments

We have to go the 457 route as could not afford it otherwise, the employer will pay all costs and one months rental, we thought that was good, its just the contract thing, we hadn't realy thought about the negotiating bit, our jobs here in the uk have been a take it or leave deal and we didnt know wether it was "expected" that we negotiate, say, should you accept the first offer when it comes to salary?
We did ask them to reconsider the "without cause" bit of the contract,The contract also states they will sponsor for PR after the 3 month probation , we thought that was good.?

Think we may stop pussyfooting (email ping pong) and ring them!!

Yeh, negotiate with them. It's expected out here when dealing with contracts. Also, make sure they offer enough salary as it all depends on where you live and the cost of living, rentals etc.

Anyway, good luck

It is more important than it seems initially. When you are about to start a new job (or seeing someone LOL) both sides go extra mile to look nicer than they are and try to skim over the discussion what to do if/when it is time to part. Then, if relationship goes pear-shaped, this is left totally unregulated. So I think it shows professionalism and care when this discussion is brought into the open.

On the flipside, this depends on who needs who. I have a rare skill set and there is not a lot of jobs for me, so when there is one I can be a bit of a hard arse, but that does not work for everyone.
