Bankrupt in the UK
If you have been made bankrupt in the UK, does it have an impact on you in Oz?
For example, do you need to disclose it when you apply for a mortgage etc? |

Yes, you do have to disclose it when you apply for a mortgage here. If you truly need to declare bankruptcy, then do it, but bear in mind that financial institutions are all interlinked these days so if you don't declare it could come back to bite you in the bum.

The consensus seems to be that moving to Oz is a fresh start; your credit history does not travel with you contrary to some popular urban myths - and I notice in this thread that someone else has had no trouble getting a mortgage after UK bankruptcy.

From memory Rodders is the best person to ask, i may be wrong but he and someone else seem to work in the finance industry and always have good advice, try searching for a debt thread and look for them.

absolute twaddle. OH was made bankrupt in the UK. No mention was made all through the visa app, we've got a 'normal' mortgage no problems and they don't even ask when going for household or car insurance unlike the UK

No, not absolute twaddle. Maybe they don't ask when you apply for car insurance, but they certainly do ask when you apply for a mortgage. You are signing a declaration saying they are free to do a credit check on you, so it would be to the bank's advantage to do one in UK or wherever it you came from. Our mortgage broker explained this to us. You said they could, so it is probably not likely they will but they theoretically could. We discovered that Bank of Montreal (where we held our Canadian mortgage) is linked with Commonwealth here.
Maybe that's the key. I know in the UK they have an agreement with Canada where they can disclose info to each other. Uk doesn't have this agreement with Australia yet though so if they did checks they would be unethical ones. Maybe Canada also have the same agreement with Australia as it does with the UK. It's very difficult for people in the UK to give info to anywhere outside Europe, unless they have an agreement like they do with Canada or have your written consent. (All this is my opinion only and not fact ;) ) |

I think the agreement is in the ability to enforce civil judgements... Have debt in the UK, get a judgement against you and the plaintiff can ask a Canadian court to enforce... not so here in Australia... but it's coming... ;)
