Advice Leaving Debt in UK
#121
Er you do realise that you're wrong, don't you?
Non payment of SOME debts (possibly Child Support, Tax, Court Fines) may be a crime. Non-payment of debts arranged under a private agreement such as HP, Bank Loans, Credit Cards isn't a crime unless you intended to leave the country owing money at the point at which you signed the credit agreement.
Irrespective of whether or not leaving debt in the UK makes a person evil, unworthy of Australian citizenship/a visa, if you don't have anything useful to say, don't post.
Cheers
Steve

Court fines I believe are a criminal offence for non-payment. However fines and credit debts are 2 different things. Tax is a more complicated one, non payment of council tax is punishable with a custodial as a last resort. But non payment of income tax will probably end up with a bankruptcy rather than prison. Tax evasion though, thats a different kettle of fish.
The pursual of many debts by DCA's is often illegal, so wether or not you think its right or wrong that some people leg it without paying, pails into insignificance. If you get time do a google search on "mackenzie hall" you may be surprised at what you read. My ex used to work for this mob, and they were encouraged with ridiculous bonus's to extort money from debtors by any means necessary be it legal or not. So who's more at fault? The debtor for non payment? The creditor for outsourcing debt collection to a company that has illegal practices? Or the DCA for working above the law?
I'm getting to the stage now, where I really dont care wether someone does a bunk without paying. Hey if they can get away with it then good luck to them

Can anyone advise on the following dilema -
My wife and I are in the process of of obtaining our visa'a to Oz, we have around £20k equity on our property in the UK (up to April 09) to bring with us, however am debating a couple of things and was wondering what effect it would have if we were successful in or migration application.
We currently owe our creditors £12k in loans and credit cards so do I
1.) Repay them and come over with £8k.
2.) Transfer the monies in my UK account and keep repaying them.
3.) Run with my money and don't look back.
We don't plan on coming back as we are used to living away from our families (currently live 200 + miles away at the moment).
My wife is a secondry school techer (degree & PGCE Educated) so we know we should not have a problem in her obtaining a job, I on the other hand work in finance so if its anything like the UK know that jobs are hard to come by in this industry.
We are moving to start again as a family.
I know what i want to do but not sure what implications would arise.
Any help please
Thanks

I love these threads... always guaranteed to start a war.
My own personal take on debt is that you borrowed the money in the first place and you should pay it off. If you are crooked enough to leg it then that's up to you.

I'm glad this was bumped up again as it gave me a chance to reread the original post.
I hadn't noticed that the OP was in Finance, which makes it all the more ironic that he would want to do a runner!
