Furthermore, their solicitor wrote to ours indicating that there were no problems. All set to exchange tomorrow 5/8.
We went away for the weekend and returned on Monday to find a letter from their solicitor which stated that actually there were a few issues re survey ie boundary wall is hazardous (doesn't belong to us and they would know that on their survey!) and that the pipework to the boiler in loft is untidy!!!! Anyway due to these serious issues they are not asking for a reduction in price or remedial work (yeah what exactly do they plan to do?) but would proceed with the transaction if we would leave our bedroom furniture which is not fitted but very nice cost us £3.5k, garden accessories, sheds and workshop, carpets, curtains, lights, mirrors, white goods i.e freezer, dishwasher etc and a whole range of other bits literally taking the whole cake!!!
As you can imagine we told them no in no uncertain terms that they could go away!!
I wrote to the solicitor and told him that unless they exchanged we will put the house back on the market, we wont do remedial work or reduce the price or leave anything here. I would rather burn stuff now then let them have it. Obviously the agent knows we are off to oz so i think they think we are desperate. yes we are keen to go but they are not going to take advantage.
Anyway the agent rang us and tried to imply that we were being unreasonable as we really wouldn't want to take those items to oz would we? we don't want to take some items true but I'm not telling those bloody snakes! other items yes.
anyway i then phoned our solicitor and he told me that our agent was apparently against us as he is charge of the whole chain and our being resistive to their requests is damaging his possibility of obtain commission down the line. Rich then phoned the agent and he wasn't there! he spoke to his colleague and advised him of our decision and also said that if he is acting not neutrally and the deal falls flat we will take it further.
yesterday the agent called me and acted as if he never received the msg...yeah right am i getting cynical in my old age?
The phone was hot yesterday and i certainly was not backing down. Anyway after a lot of discussions we agreed that we would leave curtain poles, carpets, lights, freezer and dishwasher for £500 and the agent would reduce his fee by this much.
The buyers think they've got one over on us but they haven't. The irony was that the agent said the buyers wanted it as it was before ie the poles, carpets and lights. they then came back and asked for the freezer and dishwasher which the agent will stump up for. He then came back and asked for the sheds and workshop and that we should leave them behind as a gesture of goodwill????? i ran out of that a long time ago!! Our workshop cost over £2k 18 months ago and I'm sure we can resell easily for £500 locally it is bigger than a garage. Our other sheds are also large and the children's is particularly sweet and I'm sure we will get a £100 for it. Anyway the long and short is any money in my pocket is more dollars for aus. Told him no and that if they wanted them they would have to pay for them. he never came back to me so i am expecting the phone to be hot again today.
The only problem now is that both PSS and John mason who i have decided between are now getting really booked up for end of Aug which is our planned completion. i am not prepared to pay a deposit until we exchange and have told them so due to this being our 3rd transaction. Anyway please keep all your fingers and toes crossed that we can sort things out and then exchange!! the agent is hoping for Monday. I will believe it when it happens. If all goes well we will be off to oz in October hooray!!
Sorry for the rant but for those of you in the process of selling, keep your cards close to your chest and don't give in even when you are desperate to go. At the end of the day we would have relented to secure the deal but played hard ball and it worked, I'm sure for some it may not have done.

Right Just had a phonecall from the solicitors and he has said that the first time buyer has been in to sign her contract but has not paid her deposit. They are hoping that a deposit will come through some time later today or early tomorrow morning :scared:
Now this is my dilemma our buyers have said that if we dont complete on the 9th sept due to shipping constraints then we cant complete until october 10th!! Apparently these are the people who are so brassic that couldnt afford to pay us a bean etc are going on a long haul holiday from 14th sept and wont be back until then.
I have just phoned pss and at the moment that date is available just but could go as there are a few of us requiring it. So even if it is available should I say its not and enjoy staying in my own house for a bit longer or should i go? We had anticipated to go to oz mid october so we would in effect go from our own house.
What are the pros and cons of this?

In terms if whether you go in Sep or Oct, I can't see any real difference except for time - but really it's what suits you best?? If you exchange within the next couple of days and PSS can do the 9th Sep, I'd say go for it. But if you need a extra month to get things sorted, then rather do that - doesn't sound as though your buyer is too bothered either way?
I'll keep fingers crossed that you exchange tomorrow. Hang in there - it's nearly all done!!!

I've just read this thread and really feel for you. Hopefully by the time you've read this your buyer would have paid her deposit !
For what its worth if she hasn't paid up by the end of today I would call her bluff put it back on the market, giving written notice to your agent that you intend to terminate your contract with them (they haven't had your interests at the forefront).
Its awful though, sitting and waiting, and the whole proccess being out of your control.

I maintain that the British system of selling houses is absolutely nuts and lends itself to people being held to ransom. When we sold our house in Germany last month its so much simpler. The buyer makes an offer which you accept then three day later you both go to the same solicitor who runs you through the contract together (takes about an hour) after which you both sign. Its then legally binding.
Voila.
The fact that the German housing market has been in freefall for the last three years since we bought is netierh hither nor thither

Hi Everyone
Well this has been a real rollercoaster this week. Our solicitor phoned us last night at 4.55pm to say that the tt money transfer undertaken at 10 am has just arrived to our buyers solicitor???? I thought they were quick?
Anyway our buyers are adamant that if the 9th is out then it will have to be the 10th of october.
I told the solicitor the 9th is very dodgy and will they consider the 12th to ensure availability etc otherwise any date after that is suitable for us.
Its really our buyers call whether they wish to delay or not and they will have to endure the stress and wrath of their buyers!!!! Because we are being flexible and have been waiting for weeks to resolve, and if they hadnt of mucked around we wouldnt be in this position now!!! Quite right is what he said, to be honest I dont know who is more p****d off with our buyers us or him?
This morning the solictor called me and suprise suprise the 12th will be agreeable apparently their buyer has given them some aggro heheh
Can we proceed? Yesssssssssssssssssss
I can now proudly say that we have exchanged
I also asked if they had asked or requested that they visit the property prior to completion and he said no...very good they wont be. Now I have their deposit all the cards have turned and we shall be quietly removing as much stuff as we can. I may even changed our light fittings???
Anyway huge relief all round and we have finally got there. Hopefully to be in Oz around end October! Fantastic it doesnt seem real at the moment but Im sure it will soon.

what can I say??? what a bloody ORDEAL!!!!!!!!! I thought we had a nightmare selling our house but you take the whole biscuit tin! You poor....and by now dimented....woman! Thank god you've finally done it or someone would've found you strung up somewhere!!!
Now's the time to pause for a moment..grab a drink and think of the most foul smelling fish on earth that you can put under the floorboards by a radiator...

Remove what you can and change what you can without them being able to legitimately complain later. I am a firm believer that what goes round comes round and they will suffer at some point in the future but that sort of person will never equate what happens to them to what they did to you.All steam ahead for late October. Great new and at long last. I'd go for the jugular now and remove everything that you can and either give it to charity or sell it at car boot!!! Might even do the fish trick!!!!

Im really starting to cheer up now. Ive just confirmed the hall for our party and paid, and confirmed pss and sent off their cheque, so its starting to get real now.
Really starting to look forward to our new life, but I think we will leave the buyers with a few nice timely reminders of us

I think you are right , it's all down to the agent, as soon as he knew you were leaving the UK he took the piss.
