1. If they are in ex partner's custody and not migrating, DIMIA will still expect them to do a medical unless you can demonstrate this is 'unreasonable'
2. If they are migrating with you, then you need to demonstrate you have the legal right to remove them from the UK under *UK* law. Some DIMIA officers have reportedly gone well beyond these requirements in what they demand and you could end up needing an agent very well versed in DIMIA law and policy on this subject. It also entails getting a very clear understanding of what home country law says and applying it to your case.
In both of these cases a good agent is a great help. Not every migration agent knows much about custody issues, and it's essential to choose one who does.

Thanks JAJ,
Even after all we,ve been through i couldnt of explained it without it turning into a long winded post.
In our case our agent knew very little about these issues,it was more a case of who he did know that helped us in the end.
