ICT Visa Application
Hi,
My two questions :
1.Assuming, ICT is removed from SOL list or the points associated with it are relegated to 40/50,what will be the status of the pending Independent Skilled Visa Applications that already have a file Number allocated by DIMA but are now have less than the requisite passmark ?
2.Has the situation,akin to one described above,been experienced before for any other skilled occupation( ANY) ?If yes,What had been the status of VISA applications which were allocated the file number and were under processing?

Anything can happen. Legally, DIMIA can choose to retroactively apply new regulations (including SOL changes) on applications that have been lodged but not yet been decided. However, the last passmark change in May saw DIMIA choosing to grandfather the applications already in the queue.

Anything can happen. Legally, DIMIA can choose to retroactively apply new regulations (including SOL changes) on applications that have been lodged but not yet been decided. However, the last passmark change in May saw DIMIA choosing to grandfather the applications already in the queue.

Has the retroactivity clause ever been applied anytime in the history of Australian Skilled Immigration, for applications under progress in any skill set mentioned in Skilled occupation List of DIMA,where the points attached to the skill were relegated or skill was removed from the SOL ? If yes,
can you cite the example.
