De Facto relationship
Hi me and my partner Lindsey are just in the process of filling in the visa application. We have been together for six years and have two children but have never got round to the marrying thing just yet. How do we go about proving that we have been together for that period of time ie what documentation do we require in the visa application. Hope you can help Andy

Hey there Andy - when we applied for our 138 visa (Skilled-Aus Sponsored) our Agent asked us to provide the following:
EXAMPLES OF DE FACTO EVIDENCE
1. Accommodation leases or property ownership in joint names; joint rental receipts; evidence of sharing household expenses (e.g. accounts for electricity, phone, gas, car and home insurance, etc)
2. Evidence of any other official and/or private correspondence (including family and friends) addressed to you and your spouse jointly or individually at the same address – if possible please include the envelopes - amongst other things we included postcards etc for this.
3. Evidence of other joint financial commitments (e.g. Joint assets and liabilities such as shares, personal loans, mortgages); sharing of income; operation of joint bank and savings account
4. Evidence of public recognition of the relationship between yourselves (eg. Letters addressed to yourselves by employers, sporting or hobby clubs, cultural groups, government departments, local councils, private health funds, Medicare, Centrelink, etc)
5. Photographs of you and your spouse which provide evidence that you have celebrated events together, and have shared interest and activities over a period of time. Include brief information for each photo, perhaps written on the backs, to say when and where the photos were taken and who is in them - this was even funnier as we go to alot of fancy dress parties - who would want to see that?
6. Statutory declarations (stat decs) outlining the nature of your relationship. These should be one each from yourselves and at least six-eight from friends and family.
The statutory declarations are really important and i've got a good template of the format if you want to pm me for it .

All of the things above.We threw in an obvious one which we were surprised wasnt asked for..The kids birth certificates with both your names on..

(But then we ended up getting married so we could do it in front of all our friends and family in the UK so it suddenly became irrelevant!)

We origionally sent off a few bills etc, thinking our childrens birth certificates would be enough, especially as our youngest had just turned 1! They only wanted a few more items, we got friends, work collegues etc to write letters as my partner was not on the mortgage! Oh and a few pics!......that was enough!

When questioned about it we went to the solicitor with 2 friends to swear that our relationship was genuine,we wrote how we met,what we do together,bills we share etc...Visas granted 2 weeks later.

we were told not to send many photos as they dont like a lot.
basically they just want you to prove you've lived together in a relationship for more than 12 months so 12months of utility bills in joint names, mortgage if both your names on it, bank statements and a few social invitations, flight tickets etc. info on the children.
and we were asked to do 6 references 3 from each side.
we had only just lived with each other a year, I didnt have my name on mortgage, no joint bank account still got the visa.

Our agent has told us to do a personal history about how, where, when we met and things we do together and plans for the future etc and both of us to sign. He hasnt mentioned friends doing one though.
We have loads of bills in joint names going back about 4 years and we have a 2 year old together.

Thanks everyone - guess I ought to start digging out the bills ets! We have a lovely picture of us at the top of the world trade centre - guess that means we've been together for a while plus a five year old and a two year old - and they look like Andy - Mini me! Its frightening

We sent joint bills, bank statements, my visa statement with my partner as additional cardholder, emails we'd exchanged, stat decs from friends/family, letters from friends/family, photo's, tickets, statements on our relationship etc.
Now we are sending off for an Aussie police clearance and also have complete form 1221 before we send it back to his CO.
